I got a 38R on the MCAT, have a 3.55 GPA and 3.83 science GPA.

My ECs were dominated by rugby, as I play for the University of Florida and this takes up about 30 hrs a week. It is club, so no scholarships, but we compete against other colleges. I also did one summer of Malaria research, was a TA for Orgo 2 for a semester, shadowed at an ER for about a year, volunteered at an oncology clinic for a semester, and worked as a soccer ref for a year. I also studied abroad one semester.

I'm Hispanic but have triple citizenship (including USA), speak 3 languages and lived in 5 countries.

The bad news: in September I got into a car accident and I had had a few drinks. I passed the field sobriety test but because I admitted I had drank, they took my blood for testing. I will not have the results of the test for another 2-3 months probably. I have not been charged with anything, but it is possible I will be accused of a misdemeanor, pending the blood work.

What do you think my chances are at top schools (Stanford, UNC, San Francisco, Georgetown, and local schools UF, FSU, Miami....) if I am accused and if I am not?

Your GPA and MCAT are good enough for just about anywhere; certainly for your state schools. URM status will also get you interviewed at top schools. I see no problem with you being accepted from a numbers perspective.

Intramural rugby took up 30 hours a week? Come on man, I don't want to call you out, but I swam DI college and we trained between 20 - 25 hours per week (NCAA actually caps it at 20, but most programs still go over).

That aside, your ECs sound pretty good to me.

As for the bad, I'm not sure why it takes 2 - 3 months to get your blood tests back? That sounds absurd. That test only takes a couple of hours. If you're convicted of a misdemeanor that involves alcohol and a car accident, I think that would severely limit your ability to gain acceptance to a school. Any school that looks at you is going to want to see some distance between you and the incident, so they can see it was isolated, that you've grown and learned from it, etc. Have you talked to a lawyer yet? If I were you, that would be my first priority.

If you passed the field sobriety test then there is no reason to think your BAC was over the legal limit. Only you know how many drinks you had; "a few" can mean anything from 2 - 20 drinks.

Good luck man, I would seriously find a lawyer.
 
Having recently been a foreman on a jury that dealt with a DUI case, I can first give you the caveat that the laws in your state might differ from mine, but let's take the worst case scenario, and assume that you are in my state (somewhere west of the Mississippi).

Passing a field sobriety test means nothing to the charge of DUI. It's a good sign, but IF your blood alcohol level was above the legal limit, then even a good lawyer won't save you from a DUI charge. There's another charge that goes hand in hand with that, but for the life of me, I can't remember it. Thus, you may very well get two convictions. And, people like you who drive while drunk, do kill other people.

Now for more bad news, and again, I'm speaking about my school, but driving while impaired might be enough to get rejected outright by the AdCom. I've seen it happen more than once. You'll probably get interviews, but I'm not optimistic if you've got the DUI.

The lack of a lot of volunteer experience could be a handicap. We do admit student-athletes, so it's not an automatic killer. I'd recommned getting some more in under your belt, as it can only help.

As far as rugby taking up 30 hours a week...Yes it sounds like a lot, but I included travel time. We practice/lift about 15 hours a week, and since we do not fly to games, travelling takes a lot of time.

The first thing I did was hire a lawyer obviously. He told me that part of the reason it takes so long to get the results back is because its all done in state labs, and my case is not high priority (no one was killed or anything). I wanna repeat that I have NOT been charged with anything. I don´t think I´ll be charged with a DUI, but a reckless driving charge is possible. How bad would that be?
 
My gut tells me that with a reckless driving charge only, and IF it's considered a misdemeanor, then you'll probably get interviews. However, how well you explain what happened will eventually determine your acceptance odds.

In the jury case I was on, there was no accident involved; the driver was seen by a cop weaving in and out of lane. That was enough for the stop and what led to his eventual conviction.
