Obama repeals right of conscience rule.

President Barack Obama plans to repeal a Bush administration rule that has become a flash point in the debate over a doctor's right not to participate in abortions. The regulation, instituted in the last days of the Bush administration, strengthened job protections for doctors and nurses who refuse to provide a medical service because of moral qualms.
A Health and Human Services official said Friday the administration will publish notice of its intentions early next week, opening a 30-day comment period for advocates on both sides, medical groups and the public.
The official spoke on condition of anonymity because the notice has not been completed.
The Bush administration rule was quickly challenged in federal court by several states and medical organizations. As a candidate, President Barack Obama criticized the regulation and campaign aides promised that if elected, he would review it.
Heres an excerpt.

I think i'd prefer this in the sociopolitical part of SDN. These discussions go into ideology wars really fast.

I posted it here for 2 reasons
1. As future healthcare providers it affects us. Many of us dont go into the sociopolitical forums
2. This pre osteo forum was becoming a little stagnant.

If the discussion turns into anything but it can be locked, but we shouldnt pre-emptively close off discussion simply because it can take a bad turn.

It doesn't have to be closed...could just be moved over to those subforums.

So, let me try to understand the situation from just this excerpt. Obama is repealing the regulation that would allow health care providers to refuse a treatment that is against their moral standards, correct? Is this not similar to the pharmacists in I think Minnesota that refused to give birth control to women if they had a prescription for it?

From what I understand of the regulation, yes it's similar. I think the new regulation was intended to be applied primarily to things like abortions but they left it open-ended for any sort of treatment

I understand why and don't think it will be closed, but the people that are more likely to respond with a well informed reply are ones that'd probably seek it out anyway. The forums are always stagnant. 😉 I've been here for a while now and I'm just used to these waves I guess. 😛

He repealed Bush's clause, but he's drafting a new one that is structured differently. Nobody is going to force any healthcare professional to perform an abortion if it conflicts with their moral beliefs. The issue I think is that some doctors/clinics will flat out refuse to do some of these things rather than lead a patient to somewhere where they can receive counseling/birth control or abortions. The second page of the article clarifies Obama's stance on it pretty well and specifically why he repealed it.

In posts 26 and 47 of this thread http://forums.studentdoctor.net/showthread.php?t=587253 (in which the original [highly flawed] piece of legislation was discussed) I (others in other portions of the thread) discussed the major flaw in this law. It's good it's getting repealed. It basically gave special rights to a group of people-those claiming moral objection-not given to others.
