Is it illegal for a % of my pay to go to EAP, but then get denied EAP when I need it?

This wasn't recent but..I worked at an academic medical center, and was having some mental health issues, and I was terminated for poor performance as a result. When I worked there, a percent of my paycheck always went to the Employee Assistance Program. However, when my performance started to suffer due to mental health issues, (and now that I work at another medical center, I see that the workplace I used to be employed at until getting terminated was toxic) I was terminated without being offered to go through the Employee Assistance Program. It's funny because I ended up seeing the same therapists that do the employee assistance program for that particular academic medical center, except I had to pay out of pocket.

Is this illegal for the hospital to treat me this way?

Did they KNOW you were suffering from mental illness at the time?And if they did know, who are the people who did? Did you get this information to HR? Is it in writing? Did you give them any documentation from a mental health worker you were seeing?

Needless to say, I am not at all an expert on this topic or about your specific case. On top of that, let us say it is illegal - what do you gain from this? Are you trying to get missing pay or something? Is it worth it? And how do you prove it?
