Jail Sentence for Dispensing Error ?!?!

Listen up kids. This is exactly what your employee in the good 'ole US of A would say about you if you made an error. This is what stinks. The bottomline is you are the one responsible evn though its your employer who dictates the working conditions.

I carry my own liabilty ins, which reminds me i need to renew! I dont trust any corporation, for any reason, for anything, ever...There's only 2 people I trust in my store: my partner and tech.

Well, the judge seemed to think she was a nice person, so suspended the sentence. But this comment by the judge just drove home the ridiculousness of the situation: “It is worthy of note that you resigned from the Royal Pharmaceutical Society immediately and I am told and accept you will not seek again to work as a pharmacist.”

WTF? One mistake, and she's giving up on her career? Hell, here in the states RPh's make mistakes all over the place, and DM's usually throw a couple gift cards at the patient and everyone's happy.

I wonder if with the UK's ass-backwards justice system, physician mistakes are dealt with this harshly.

Yeah he suspended the sentence, but if she wasn't pleasant, locked up for 3 months?? Bulls--t! God damn, we are HUMAN. We make mistakes and this Rph's mistake did not lead to his death, according to the autopsy!

That is unheard of - I am blown away... What are the legal ramifications here? Typically, it wouldn't be a criminal trial but a civil trial correct? Being sued for damages?

I do agree with that line about we are the professionals. If you see unsafe working conditions - it is on YOU - US - to put a stop to it. That means sending home an IV technician that is clearly sick (and sneezing / coughing) - it means closing the pharmacy for lunch is no one is there to cover it.

Company policy be damned - Do the right thing... It is through no stretch of the imagination that ANYONE could be in her shoes right now.
 
A friend of a friend got a ruinous fine from our College of Pharmacists for dispensing the wrong dose of Synthroid. The patient didn't take a single dose; she noticed they were the wrong colour, and brought them back, where the pharmacist switched them to the right one but...the patient also happened to be the extremely neurotic daughter of an equally neurotic Queen's Counsel lawyer, who went to the College of Pharmacists guns blazing.

Bottom line...it's not the seriousness of the error that determines your punishment. It depends on the patient's or their family's attitude.

Best CYA you can do is 1. carry your own liability insurance and; 2. when you make a mistake, handle it right; ie, apologize profusely, offer refunds, gift cards, whatever.
 
what's about US law? Will you loose your license or being convicted with one dispensing mistake?
 
Did anyone see the link at the bottom of the page, I presume to an editorial that dispensing errors should be decriminalized?

I'm so glad that I live in the United States right now and didn't want to be a pharmacist in England.

This is particularly funny considering Prince Charles is into all sorts of homeopathic quakery and promotes it liberally.

You have a link or some other reference. There are no criminal violations for any state pharmacy act. You would have to do something criminal to go to jail that would be outside of any pharmacy code....
