Is a company that hires psychiatrists as independent contractors a target for malpractice lawsuits? Or is it just the psychiatrist that gets sued because they are independent contractors with their own malpractice insurance?

From what I've seen, attorneys start by casting a wide net. Contractor or employee doesn't seem to matter to them. It is all about insurances settling or taking as many entities as possible to court.

I would be much more concerned about indemnity clauses. These can occur frequently in contractor contracts, and they are very dangerous to physicians.

As do I. It's funny when you're one of a handful of residents named in a lawsuit (person was lucky another resident DID something, because the med ER missed a pretty significant, obvious find), and your program makes no effort to talk to you about the process. It's also funny when you're only put in contact with the hospital's attorney (who's interest do they have?) who never calls you back.
