You don't. That's why some specialties like OB/GYN, Neurosurg, etc. with really outlandish med mal rates will have to abandon certain areas. 5 years ago Nevada lost many of its OBs and women were going out of state to deliver. That drove the legislature to put through some tort reform legislation but we've still got a long way to go.

The average across all specialties? I don't know but I don't know that that is a useful figure. What you really care about is the average of your specialty.

If a doc is a hospital employee (which is the exception rather than the rule) the hospital may pay their med mal. Most docs in EM, anesthesia, radiology, path and other hospital based practices are in groups that pay their med mal from money they make billing patients. For other docs like surgeons, internists, FPs, OBs, and so on they either pay their own or pay it as groups but it's still coming out of their pockets.
