Hi everyone.

I'm in a bit of a dilemma and in need of some advice. I am a PGY1 currently and applied to both ACGME as well as AOA anesthesia programs. I have been recently offered an out of the match position at an ACGME program, which of course I will accept. But as the deadline for withdrawing from the AOA match has already passed. I don't know what to do.

What happens if there is an AOA match violation?

I'm not a DO so I don't know this for sure, but could you just turn in a "blank" rank list with the AOA. That way, the programs would not be adversely affected since you would have no possible chance of matching with any program. If you turn in a list and match to a position you have no intention of accepting, the program loses. It would seem that a blank list would solve the issue. Hope it works out for the best for all.
I still don't understand why the "loophole" exists to accept DO candidates for out of match spots, but I would not fault you for pursuing it.
 
Unfortunately, I have already ranked 1 program. Like I said the deadline was on 1/23/2010.

I was worried about not matching, but now, I'm worried that i will match. (sucks I know)

Any other input would be greatly appreciated.
 
I think the program deadline is the same. I will try calling the people that run the match.

"Match Results and Contracts

The results of the Match will be available for all participants (students and institutions), as well as for the colleges of osteopathic medicine and OPTIs, on February 8, 2010. The results of the Match are binding.

The institution must complete an institutional contract for each matched student, and send it within 10 working days after receipt of the Match results to the student for his/her signature. Failure to do so places the institution in violation of its Match commitments and could jeopardize continuation of the program. In addition, if an institution fails to send a contract to a matched student within 10 working days, the student may be released from the Match obligation without prejudice.

After receiving the contract from the institution, the student has thirty (30) days in which to sign the contract and return it to the institution. Beyond 30 days, the institution has the right to notify the student of its decision to withdraw the contract offer. In such cases, when a contract is withdrawn because the student fails to sign it, the student is in violation of his/her Match commitment. Such a breach of contract precludes the student from taking any other AOA-approved training program for one (1) year, and from AOA approval of any postdoctoral training during that year. Only students for whom the institution has a signed institutional contract may receive credit for the OGME-1 year.

Note: Only the student and the institution are parties to the contract. Neither the American Osteopathic Association nor National Matching Services Inc. is a party to the contract, and thus neither has enforcement jurisdiction or legal standing to intervene in contract disputes."

Try to withdraw or call the program to say that you signed a contract, but definitely sign the ACGME contract. If you do match at the DO program, don't sign their contract. You will be in violation, but they have no recourse other than to not approve that year for AOA credit. Whatever. The AOA has no legal teeth to enforce the match, only AOA-associated penalties, which are paltry.
 
the honorable thing to do would be to tell the ACGME school you shot yourself in the foot and might have to match with an AOA spot.

Why the ACGME allows DO students to match is something i will never understand.

I am very grateful for the opportunity offered to me. I will most definitely take the ACGME position.
 
As a follow up, I have contacted the other program, and it seems like everything will work out.

I am now ready to withdraw from the NRMP. My question now is do I pick "applicant request" or "Non- NRMP position"? What is the difference?
