Misdameanor conviction.

Hello all. I am applying to get my pharmacy tech license in Arkansas. I am a little nervous because I have a misdameanor conviction for writing a hot check about a year and a half ago. I paid the fine right away and there was never a warrent issued, so the misdameanor only exists at the district cout level (lower than state level) in the city of Sherwood, AR. This shouldn't show up in a normal ciminal background check. Now I called the Arkansas Board of Pharmacy and they said I need to send in the court records and a written statement and they will review it, but it shouldn't be a problem. I also called the city today where I have the conviction, and they said I could probably write a letter to the judge and the get conviction expunged. It was just a $4 hot check and it was an honest mistake. So, should I go ahead and apply for the tech license and send in the court papers? Or should I wait to see if I get it expunged and apply and put that I have no convictions? I need some advice please. I'd hate to see a hot check keep me from being a pharmacist. Thanks,

How long will it take for the record to be expunged and how badly do you need this job?

Once the judge gets the letter usually 2-3 days. As far as the job, its not an immediate necessity, as pharmacy school is 2 years off. But the sooner I can start getting experience the better. I do not think a misdameanor like this would keep me from getting a license and that is what I was trying to find out here...if someoen else had been through something like this.

With pharmacy school being two years off and becoming an actual pharmacist is six years, then I don't see any real harm to your application by waiting a little while. Perhaps Farmercyst and/or any other past/current Arkansas residents can chime in but felonies are generally the no-no for state boards. I can't speak for Arkansas' board though.
 
Even if you get it expunged, you may have to report it anyway. Same goes for when you apply to pharmacy schools.

It its not on my record then why would I have to report it? Assuming I get it expunged.
 
if the questions is Have you ever been convicted of a misd.? for the pharm license (im not sure if it actually asks this) say, yes, but expunged. that way you look like the most honest, upstanding pharmacist that you should be. i'm in the same boat as you, just different misd and from a different state. if you are worried about it reporting it to a school, call the admission representative anonymously and ask if someone has a misd record but is expunged if they expect you to put it on their app. the school i'm applying to doesn't need me to put it, since mine is already expunged. good luck👍.
 
ADCOMs have a right to consider: "Will this applicant knowingly accept hot prescriptions?"

Letting in misdemeanors is a slippery slope. Next it will be light felonies and then who knows. A pharmacist's high salary is not only based on knowledge but also high moral standards. Pharm schools have done a good job thus far weeding out the bad apples.

Because sometimes when you apply for a job that requires a background check, part of your application includes a form that authorizes the employer to search any and all records they choose to search. Your application will include your signature on that form., authorizing the release of information. Since you've now authorized the employer to obtain any and all information about you, you've just given them the green light to get all past information, which will include anythng that's been expunged from your record.

Jobs that will require security clearances (including joining the military) will also have that same kind of form. "Expunged" means it doesn't show up on publicaccess records, but that information is still there for anyone to get, as long as you've authorized the release of information. Guess what- your application probably included a form, that you signed, that authorizes the release.

Oh please, give me a break🙄 Yes i own up to my mistake and admit it, but to suggest I have moral problems because i accidently and unintentionally wrote a hot heck for 4 dollars is far fetched. I was immature then and didn't handle my money well, but besides a couple of traffic tickets I have a perfect record. Think you're going a little too far on that one. It didn't stop me from being a teller at Bank of America and it certainly didn't keep me from getting the security clearance for my HAZMAT endorsement to transport hazardous materials on our nation's highways when I was a truck driver.🙄 Give me a break.

Srleslie, i wouldn't worry about it. They give you AMPLE space and time to explain yourself on the application as well as during the interview process. They just want to make sure they're not bringing in someone who was convicted of drug possession or violence or something like that. Theft would probably be of a concern too...but a hot check? psh...that's why banks create overdraw limits. It happens to lots of people, the adcoms will understand. Just report it =) it'll make things easier later. They won't judge you on it...you'll get in more trouble if it gives the appearance you concealed it.
