NBOME Caught Red Handed Failing Disabled Student

Running with the assumption my link is the actual case, I think the school is innocent. They can't force the accomodations for boards and the student failed comlex 1 once and comlex 2 three times (between the pe/ce).
 
Eh, the guy MIGHT have a case here. His biggest legal mistake was not getting an ADA specialist lawyer BEFORE requesting accommodations.

The case against Plainview is probably unlikely.

He might have a case against the comlex folk, but the school doesn't seem to have done anything illegal

yeah, that's my thought too. If he has anything against the school it would be unlikely without an obvious COCA violation. I don't see anything in his case that would be explicitly against LCME rules, but I have no idea how much the osteo regs differ. Either way any chance would depend on how well the student documented his encounters (and how well the school did or didn't as well)

I had a patient last year who won an appeal with the NBME for a disability accomadation case last year after a fail. They are VERY specific about what they need to see documented, and the ADA lawyer the student retained wasn't cheap.
