Hello fellow doctors,

I would like to seek some legal advice from dentists who passed thier clinicals after giving the RT. I am a graduating dentist and on H4 visa. What kind/category of visa do I need to apply in order to begin practicing in the US. I just have no clue of this system. Even if you know a good lawyer, who has had experience in dealing with medical professional peoples, whom you can give reference to will be greatly appreciated. Thanks

I WOULD SAY THAT FIRST YOU SHOULD INVESTIGATE WHAT STATE YOU WOULD LIKE TO PRACTICE IN . THEN GO TO THAT STATE OR STATES WEB SITE WHICH ALL THE INFORMATION ON YOUR IMMIGRATION STATUS IS LOCATED AND GO FROM THERE, EACH STATE HERE IN THEUSA HAS A WEB SITE CALLED THE OFFICE OF PROFESSIONALISM OR STATE DEPARTMENT OF HEALTH OR STATE DEPARTMENT OF EDUCATION THAT WILL EITHER LEAD YOU TO THE CORRECT SITE OF INFO OR GIVE YOU YOUR ANSWER DIRECTLY I WOULD NOT GO TO A LAWER RIGHT OFF THE BAT YOU MIGHT NOT NEED TO AS OF YET.
HERE IS AN EXAMPLE LETS SAY YOU WERE LOOKING INTO NEW YOR YOU WOULD GOTO THIS WEB SITE
http://www.op.nysed.gov/dent.htm
TRY THIS OUT AS IF YOU WERE RESEARCHING A STATE THAT YOU ACTUALLY WANTED TO PRACTICE IN.
ALL STATE DEPARTMENT HAVE THE SAME MORE OR LESS WEB SITES SO YOU CAN GOOGLE THE INFO GOTO THE STATES WEB SITE AND SEE WHERE YOU ARE AS FAR AS LEGALITIES AND THEN SEK THE NEXT STEP THAT WILL LEAD YOU TO GETTING YOU TO PRACTICE HERE IN THE USA-

If I understand that correctly, you wanted to know the visa options for you to practice dentistry in California after passing RT and clinicals..
1) You need someone to sponsor H1b for you. This year quota is already over in June, so you need to wait until April 2007 to apply for the next fiscal year. So you need to wait until 0ctober 2007 to really start working if you chose this way.
2) However, any university, government organizations, research institutes, non profit organizations are exempted from H1 quota system and they can apply for your H1 ANYTIME of the year.
3) I guess your partner is on H1B, so you both could get green card if his employer has sponsored him for green card.
4) There are some other routes like: extraordinary ability, national interested waiver. But both of these are becoming very difficult these days. If you have extremely good publications, awards at national level (or Nobel Prize etc!!), you can apply under this category. But remember this is very difficult route.
5) Last and informal way. Dump your present partner and marry a US citizen!!!!
