Hey everyone,
I'm currently a 3rd year student and unfortunately received a NYC open container civil violation $25 "Pink Summons" last night. The officer said if you just mail in the $25 check, it gets taken care of and you won't have any criminal record since its a civil violation and not a criminal misdemeanor. My question is how this will impact my residency application, if at all. I heard it might be able to be seen on background check if they specifically look at NYC violation records, but shouldn't appear in any criminal background check. Will this hurt my residency application?

Thanks!

it is like a parking tkt, don't sweat it

I got one in another state when applying for medical school, it shows up on your background as a class 4 misdemeanor...akin to having a dog w/o a leash, but still class 4.
The cop told me what he told you, because??? Idk why. Look up the city's specific law. I paid the 25 because I had been accepted already and had interviewed, but I suspect that it kept me out of my no 1. Talk to a lawyer even if you're from out of town, its worth spending 300 bucks because you got in trouble late in med school when you 'should be maturing and making professional decisions'. If it was m1 I'd have just paid, but this may be something to address further at this point.

That's all I know about that.

Police officers aren't required to know the law, nor are they held accountable if they don't. It's your ass - stuff like this is too important to trust to internet lawyers on a medical forum. Ask an attorney, not SDN. 🙂
