Since you have no signed contract with an out of network insurance company are they allowed to audit you since i believe in the contract with in network insurance companies you have to sign for this to be agreeable to this if i recall?

Anyone can attempt an audit of anything. If the insurance company denies payment without an audit, the patient may sign a ROI to have records sent to the insurance for an audit. Without a ROI or subpoena, I don't send records.

If you are out-of-network, i.e. you have not signed a contract with an insurance company, you are under no obligation to provide them with any information whatsoever. In fact, if you do not have a ROI from the patient, you risk violiating patient confidentiality if you provide such information to insurance and do not get the patient's permission to release the information.

The insurance company may deny payment without the information but that is ultimately between the patient and the insurance company. I inform all patients up front when they inquire about this and clarify what I am willing to do and what I won't do when it comes to providing insurance companies with information.
