Question About a Misdemeanor

Hi guys. I got into Buffalo and they require a background check. I was charged with a misdemeanor when I was 18 years old and got off on a youthful offender status. That means that my record is sealed and I can check off "no" on a form that asks, "Have you been charged with a felony or misdemeanor." However, when I called the police department and confirmed this they said that was right but if there is a question that states, "Have you been arrested" I have to check "yes." Could this severely screw me and is what this person say true?

it is hard to answer with out knowing all the details. The truth is always the best... if anyone finds out you mislead them.... they can take actions against you. You will be filling out forms for life.... you licensure to practice, your narcotics license etc...

see if you can have the charges "eliminated" = esponged(?)

if have accepted residents over the years in similiar problems in youth - like misbehavior and DUI

this is not leagal advice... it is my opinion only..... you should always ask a legal expert for there comments

go to a lawyer or save money in doing it yourself by going to courthouse and get some legal secty or legal clerk to help you to get your charges expunged from record just go and ask how to expunge they will know so you can be sure not to come up
 
Having a record "sealed" means nothing because certain entities may still have access to it (courts, police, schools). You need to check on having your records "expunged" which is complete removal of your record. This WILL affect your application because you don't want to select the wrong answer choice and have it bite you in the rear. Check your lawyer for more info. We as medical professionals do not even provide medical advice here on SDN. We most certainly aren't capable of giving you legal advice. 😳
 
Tho it could hurt, telling the truth is the only way to go. You can attempt to get the record expunged, but in some moral sense you are still being dishonest when you select "no". I dont mean to say i wouldnt do the same.
that being said, I got charged with a misdemeanor charge of disorderly conduct and had no choice but to select yes to these types of questions. It was asked on my interviews, and i told them to truth about what happened. luckily, i was still accepted to 2 schools --> everyone messes up sometimes, the unlucky ones get caught.
