should i sue CVS for retro pay?

this is in regards to night differential for working as night pharmacist.

in feb 2014 district management specified night pharmacists cannot get Night Rate for the hours before midnight. from feb 2014 - Oct 2015, that is worth $5,000+.. cvs management have acknowledge the error and are now paying correctly.. night pharmacists in the district are now entitled to night differential for hours covering "entire" shift. not just after midnight. but they will not retro pay for the errors feb 2014 - oct 2015... the union rep was unable or unwilling to push for retro pay.. my question.

1) since cvs admits wrongdoing, why can't the union request retro pay ?
2) should i sue CVS for retro pay?

if you're represented by a union and the union has accepted this then you're probably out of luck on that 5k. I would consult a lawyer and see what he says if you really want to go after that 5k....probably not worth it though cuz you'll end up black listing yourself from future retail employment.
 
Review what you can and can't do regarding your union. If I was paying union dues and my rep was unable or unwillingly to push for what I felt I was entitled I'd make sure that I understood why. There's either more to the story or you should probably get a new rep.
 
The plus of union representation--you don't have to do any negotiating yourself. The negative--whatever is negotiated with, you are stuck with. I doubt you would be able to sue, because you were in a union, and the union agreed to no back pay. But hey, look at the positive, you still have a job when most CVS night shifters lost their jobs.

I was in your shoes, except I was an intern and my situation was a little different from yours. In summary, CVS refused to retropay and since the sum amount wasn't nearly as impressive so I ended up letting it go. Pharmacy is a small world so I would definitely consult with an experienced lawyer before deciding on anything. Wish you the best of luck though, pleases keep us updated if you decide to follow through.
 
You'd burn thru all your cash hiring lawyers before you see a dime coming to you from CVS if you try to sue them. More than likely, union should push the issue for the whole overnights workers, if not you are out if luck.
