Hi,

If I've been terminated from a company and now I plan to apply for a different company should I disclose that I have been previously terminated? Also is the company legally allowed to tell any other company that I have been terminated?

Any advice would be helpful! And happy new year to everyone out there 🙂
 
Most companies don't reveal why you were terminated. It's up to you to be honest up front and tell them during your interview. Unless your termination relate to drug diversion, I wouldn't worry about telling them why and what you learn from it. Just phrase carefully.

This article might have some good pointers for you. As you’ll read, you can ask your HR person what will be disclosed. If something does not sound right, you can try to negotiate.
For the most part, employers know that disclosing anything beyond dates of employment and position is a liability. For all they know, you could be the one calling. Better yet, you could record the conversation.
Hiring a reference service and get references on yourself seems like a good way to go about it.
It happens. Keep your head up. Clearly, it was a mismatch. Do some soul searching and identify red flags. I’m sure they were there all along.

What was the reason for termination?

The termination was due to leaving the pharmacy to throw quarters into a meter to prevent a car ticket. The pharmacy was left "absent" without a pharmacist for those minutes @PharmacistFl12
 
I would just be upfront about that.

You learned your lesson. Never to leave the pharmacy. If you have to leave the pharmacy you need to remove all staff and close the gate. You reviewed all applicable state laws, took extra state law CE, etc, etc.

I can't believe you got fired for that honestly.

I'm sure they probably had some type of issue with me and used this as an excuse but I'm just assuming...I was with the company for 7 years (including my intern years) and no I do not get any unemployment benefits.

Why are you not applying for unemployment benefits? I am sure you would qualify. It is money that you had put into the system. It is only fair you get some of it back.

Indeed, apply for unemployment. That is going to be state dependent, but like in IL, generally anyone fired gets unemployment (exception would be stuff like stealing from the employer, workplace violence, etc.)

Apply for unemployment. That’s money you’ve paid into the system. The unemployment office only cares that you were fired and that it was not for stealing, misconduct, etc.
You have to think hard because you were not fired for leaving the pharmacy for a minute or two to feed the meter. At some point, you must have said something to someone and they didn’t like it. And now, they’re retaliating. Remember that in a court of law you don’t have to prove there was retaliation. You only have to create reasonable doubt. So there you have it.
Otherwise, if you belong to any protected class or minority group and you are in a very conservative and homogeneous environment, then that might have made you the outcast and target of discrimination.
Get a lawyer and go after them. You have nothing to lose. The law firm keeps 60%. You get 40%. If you are not awarded anything, then you owe the law firm nothing.

Go ahead and apply for unemployment. Your former employer may try to argue it. It’s theur word against yours. The clerks at the unemployment office are typically very cynical and on YOUR side. They love it when a company has to pay their share.

Sounds to me like this isn't the first time you have done this -just the first time that you have been caught or called out on it (to your knowledge).

In other words, there's a snitch in your camp and the manager didn't have any reason to fancy you.

Either a snitch or asset protection. They’re always watching the pharmacy through their 14 cameras

I would just tell them you quit. As a famous drug dealer once said, "Lies are necessary when the truth is too strange to believe." I think that a hiring manager will think that there is more to the store than what you are telling them. And with such saturation, they don't have to take a chance on you. I think you have learned your lesson and won't do it again. But I have known many pharmacists who have left the pharmacy unattended for various reasons bathroom break, breastfeeding etc. It is stupid that we can't shut down the pharmacy for like 15 minutes.

OK- serious question: does a pharmacist going on a bathroom break constitute "leaving the pharmacy unattended"?

I can see a case made for leaving the building to plug a meter, but a bathroom break seems...a bridge too far.

In Florida pharmacists are specifically permitted to leave the pharmacy for "hygienic reasons", which I think is a euphemism for potty breaks.

I think I recall reading on SDN that there is a state that requires the pharmacy to have a bathroom inside the pharmacy so that the pharmacist doesn't have to leave the pharmacy to use the toilet.

It doesn't if you don't get caught. However, I believe that if you get fired for doing something like that someone had it out for you. I knew a pharmacist who worked at a pharmacy that was so slow they only got 20 tech hours each week. There were times when she had no tech whatever and she told me she could call the manager and have him stand watch..rules be damned.

We had one in the pharmacy of the Florida hospital I used to work in. You better believe I still left the pharmacy and walked down the hall if I had to take care of anything serious.

Where the **** do you work? I leave the pharmacy every day to go feed the meter or to grab lunch/coffee. No one has ever complained.

True but always contest. Some employers are trying to find every little thing to avoid paying unemployment.

It's not where that he works.

It's how unlikeable he is to the point where someone would go out of their way to out him.

Everyone you work with is a potential snitch.

You are both wrong and right at the same time. This totally depends on the state. In some states, being fired for cause (any legal cause) means no unemployment. Other states like IL, give unemployment for any reason, even if fired for cause (except for a very few exceptions, ie stealing, workplace violent.....but being fired for normal job related causes, ie incompetence, lateness, no-showing, not doing ones job, refusing to follow policies, means the person still gets unemployment.

Since we (at least I) don't know what state the OP lives in, and the OP apparently doesn't know what the unemployment law is for their state, they need to file. Worst that can happy is their unemployment will be denied if they live in a state that denies unemployment for being fired for cause.

Are you in retail? That's generally not a good idea to leave the pharmacy unless it is for restroom breaks. I usually send my tech to go and get me lunch or get something out of my car etc..

In my state unemployment is a given unless you’ve done something really wrong.

You actually do qualify for 6 months of unemployment benefits. Even if you are fired you still have a right to unemployment as you paid into it. Rarely a company will fight you if you claim it after being fired.

If your state has state income tax then your earnings and how much $$$ in taxes you’ve paid, determine your unemployment benefit. You prepay and your company pays when they fire you and you start collecting.
I’m sure every state has their own version.

In my experience the company's never contest it as it brings up bad blood and the small amount of unemployment payment is not worth the risk of aggregating a wrongful termination lawsuit from the former employee or worse a civil right violation. I have never seen or heard of a company contesting it.

If you were a manager you would be very well aware of it. The company contests every claim. The first thing you do Is turn in all your written warnings you issued along with a description of reason for termination. Then it may or may not go to a hearing after that.

I understand why they are doing it but it is not worth it. Someone may come back with a shotgun. Pay them and let them leave.

That is why you always need dirt on your employers. Never play nice when they are not playing fair.

If you work in hospital or longterm care, you won't get in serious trouble for this because there are other pharmacists on duty to supervision the pharmacy. The problem is most retail don't have much overlap. So more like to face job termination in retail.
 
Thank you everyone for your responses! I work in retail, & I will look into unemployment benefits, but I always assumed I wouldn't qualify for any benefits since I was terminated and it was my fault.

Three large, non-medical companies. I have heard urban legends of companys fighting it for being fired vs laid-off but in reality I have never heard of a company contesting it. Interesting. Didn't the company already pay into the unemployment insurance though so the cost would only be their increased insurance premium?
 
Nope...do not reveal you were terminated. I have been terminated twice as a pharmacist and I never disclosed that I was. I have a marking such an occurrence could flag you in the system and put you closer to the bottom of the list. Even if I am correct, it would allow HR leverage over salary offerings as they know you are desperate for a paycheck.

Always file for unemployment. Even if the company contests you can always appeal. It's iffy if you would get it for the reason you stated. It could go either way honestly.

exactly...always apply for unemployment. It is for time like this.
 
Did you sign something when you were fired? If you admit breaking a company policy good luck on the unemployment. Don't tell a prospective employer you were fired. Come up with a reason you quit before having another job lined up.

I have hired hundreds of people and only one candidate ever admitted to being fired. I know many of the others are lying, I expect them to lie. Most say they left voluntarily or were layed off. If they held a recent previous job longer than 3 years I figure they probably aren’t too bad. If they have had 5 jobs in the last 2 years I steer clear.

My RPH always had to leave the pharmacy to run to move her car because the morning rph didn't leave yet and there's only one parking spot. She'd be gone for like 10 minutes. She's awesome but it's quite annoying because I can't get stuff done. But ya to be fire it's crazy.
