When should a dentist report dental neglect to authorities?

On January 22, 2011, the dental treatment notes indicate that a developmentally disabled adult was “under treatment [to] determine if full-mouth extraction needed, or restore w/ RCT, SSC and partials as needed”.

Between March 2011 and October 2011, the developmentally disabled adult had 13 tooth extractions performed.

On January 10, 2012, the developmentally had a dental appointment, but it was just a cleaning. The dental records indicate: “nformed caretaker that patient needs tx in or ASAP to prevent further deterioration of dentition.” The notes also indicate “Schedule OR tx. Call Mother to discuss”.

On October 6, 2012, the resident went to the dental clinic for the last time. He had a routine cleaning, after having 13 teeth extracted during 4 previous appointments. The dental notes indicate that the developmentally disabled adult still had 15 teeth. The dental notes also indicate “caries present on almost every tooth”. The very last entry in the dental notes indicate: “NV: OR tx” - meaning “Next visit: operating room treatment”. The disabled adult never saw the operating room at the dental clinic to have any restorations performed.

Please note that the agency is a non-profit agency serving developmentally disabled adults throughout a particular county. Is this a case where dental staff [who are mandatory reporters of abuse and neglect under state statutes] should call the abuse hotline or contact authorities to report dental neglect?

The last paragraph should have read:

"Please note that the caregiver is a non-profit agency serving developmentally disabled adults throughout a particular county. Is this a case where dental staff [who are mandatory reporters of abuse and neglect under state statutes] should call the abuse hotline or contact authorities to report dental neglect?"


Sorry, I should have proof-read the text before posting it. It is with the "caregiver" that my concern lies. We are not dealing with a parent or legal guardian, who may be unsophisticated, but rather an agency licensed to work with adults with developmental disabilities - even though the dental notes refer to the mother giving consent.

Any thoughts?
 
I don't know that you are going to get advice about this here on these forums. I am not entirely sure that this isn't a violation of the TOS somehow, but even if it's not, you are probably better off seeking advice from a social worker or an attorney about what to do than here on these forums. If you want to ask a question like this on a forum, then Dental Town is probably better suited for that.

Why are you bringing this up again? I disagree with your assertion in that thread that a public forum is a good place to discuss this matter. First of all, you are skirting dangerously close to PHI. Also, I have my doubts that you work in the dental profession which leads me to wonder what your true motivation is.
