Who is allowed to be in the pharmacy?

Hey everyone. Just wanted to know who is all allowed from a legal perspective to be inside the pharmacy. Obviously pharmacists, pharmacy interns, certified techs, tech trainees are all allowed.

If you have a cashier person (not licensed as a tech) for the sole purpose of ringing out people at the pharmacy, can they be located inside the pharmacy area where inventory is located? I am not too sure on what the rules are on that so would be great if someone can enlighten me. Thanks

Yes. Some pharmacies have pharmacy clerks (no cert/license).

-Do the clerks have to be registered with the Texas board of pharmacy since they will be located inside the pharmacy on a daily basis?

-Would checking daily inventory received be off limits for a clerk?

I couldn't tell you, as mentioned previously, this may be a state-specific matter

EDIT: My first comment was for Texas. Anything outside of Texas, I do not know.

They do not need to be registered if they will be doing administrative duties.

Yes, they would need to be a pharmacy tech / tech-in-training (both of which needs to be registered with TSBOP); however, anything OTC is fair game.

Depends on which class of pharmacy. Basically, anyone who the PIC or pic allows in there. Unescorted, it actually does depend on the class (by the way, they always ask on the TX MPJE about nurse access after hours for Class C/C-S and about what can a Class H do). In terms of duties, it's somewhat complicated.

Ah thank you. I was asking regarding class A (community pharmacy). So if the PIC allows a clerk in there then its fine I take it, no board registration required.

What are the rules on nurse access after hours for ClassC/C-S?
 
Keep in mind too, you do have to tell loiterers to leave the area as well (I.e homeless, people just wanting to sit down, etc.) due to HIPAA. I'm not aware of any particular time limit, not sure if any states have any set in stone (just use judgment).
