How is this not age discrimination?

I think the time limit is more of a reflection that the medical knowledge will no longer be fresh if you are more than 3 years out of medical school when you start your intern year, than an attempt at age discrimination. Regardless of if you are 28 or 58, 3 years away from the material is a nice chunk of time.
