Background check question

I am currently filling out my TMDSAS application for medical school. on the part asking about misdemeanors and felonies the question asks for only felonies and misdemeanors. My freshman year i received an MIP, however i am currently getting this expunged. It states that you do not need to disclose any juvenile records taht have been expunged or sealed. Second, I was arrested for public intoxication in Alabama. In Alabama, public intoxication is not a misdemeanor or felony, but rather only classified as a violation. I am also pretty sure that after paying the fine the public intoxication violation has been sealed. My question is if I need to disclose either the MIP which has been expunged, or the public intoxication which was only a violation and not a misdemeanor or felony. I am assuming that I do not need to since it clearly states i dont have to disclose anything that has been expunged and it does not ask for violations only misdemeanors and felonies.
 
MIP, disclose. PI, disclose (you were arrested).

Juveniles are sealed, no need to disclose, unless it was something a lot more serious like rape, murder, etc (that'll show up...)

The only reason I am hesitant to disclose is it asks
"Are you currently under charge or have you ever been convicted of a felony or misdemeanor, or have you ever received a felony or misdemeanor deferred adjudication?*

You need NOT disclose information about any of the following:
* you were arrested but not charged
* you were arrested and charged, but the charges were dropped
* you were arrested and charged, but found not guilty by a judge or jury
* you were arrested and found guilty by a judge or jury, but the conviction was overturned on appeal
* you received an executive pardon
* a juvenile or criminal record that has been sealed or expunged. Failure to disclose information that is not in fact expunged or sealed may result in the applicant being denied admission
* minor traffic violations"

Because my MIP was expunged it says i do not need to disclose it. Also, my PI was a violation which is not a misdemeanor or felony. The question does not simply ask were you ever arrested. it just asks if i have ever been convicted of a felony or misdemeanor. so by answering no I am telling the truth arent i?
 
I'd do a background check on yourself and see if it comes up on it. MIP was it in juvenile court? If not you may need to say yes. Try doing a background check yourself.
 
Freshman year I assume you were over 18. What does MIP stand for?
 
You don't need to disclose it. The instructions specifically tell you that you do not need to disclose certain violations, so there's no need to volunteer information and you aren't being dishonest. You might be asked about expunged records on secondaries (definitely will for residency/licensing), so it will probably come up eventually. That being said, the violations aren't anything that should keep you out of medical school as long as you are contrite about it when asked.

Why do I need to disclose the MIP if it has been expunged? does it not state that expunged criminal records do not need to be disclosed?

Which one is it? Still getting it expunged means not expunged, therefore list it. If actually expunged, no don't list it.
 
If it's expunged, you should not list it. A real expunge applies to the arrest as well.
 
If you follow the instructions on the prompt, which clearly say not to list expunged offenses, then you are not being dishonest. Even if you did list it, a minor in possession of alcohol is not a big deal. It happened awhile ago, and is relatively easy to explain in a contrite manner.
