To whomever it may concern,

I am suffering at the hands of an administrator.

I was recently denied my right to participate in graduation ceremonies for no justifiable reason other than to prevent embarrassment from befalling an instructor (who happens to be the Executive Assistant Dean); because of a "failing" grade he unjustly administered IN A 2 CREDIT HOUR, PASS/ NO PASS COURSE which I SUCCESSFULLY HAD OVERTURNED (it is my belief that he assigned the Failing grade unfairly, disparately and prejudicially).

Having the "failing" grade repealed did not sit well with the Assistant Dean/ the Primary Course Director. He and the two other course directors were therefore forced to either allow me to "Pass" or assign a ?No Report," which is what they did. They subsequently have assigned a rigorous, and by Clinical Faculty's opinions, "nearly impossible" and "drastic" set of requirements to complete to allow me to complete the course and to graduate.*

[*Regarding: Participation in Ceremonies at Graduation; It has been established that a student who has not met all of a courses requirements and thusly been assigned a grade of ?No Report,? or an ?Incomplete? is still allowed to participate in Ceremonies at Graduation. However, the student will not receive their diploma at that time. There were other people in my class who also had ?No Reports? and were still allowed to participate in this once in a lifetime experience, I was not].

This course is titled "Patient Management and Professionalism." The compendium of the course cites 24 methods of evaluation, however there is NOT a definition as to the weight that ANY of these evaluation methods will carry in determination of a student's grade. What is more, the course directors have elected to apply the evaluation methods in an irregular manner, applying some evaluation methods to some students and other methods to different students. In my case they elected to use NONE of the cited evaluation methods (all of which I have successfully completed) and to base the determination of the grade solely on the Associate Dean?s personal opinion of me.

BELIEVE IT OR NOT, they justified their actions by citing an obscure passage in the Student Bulletin which states THAT AN INSTRUCTOR MAY ELECT TO FAIL A STUDENT, REGARDLESS OF THEIR ACADEMIC STATUS OR ACADEMIC ACHIEVEMENT AND BASED ENTIRELY ON THEIR OWN PERSONAL JUDGMENT [Note that I have investigated the grading and evaluation criteria of many Midwestern dental schools and discovered that my college is the only entity which touts justification for such an unfair evaluation, an subjective means of evaluation].

To put this 2 [TWO] credit hour course into perspective, please note that I have been a student of excellent academic standing while I have been in attendance at the College of Dentistry for the last 6 (SIX) years [first as a dental hygiene student in the B.S. program, then as a dental student], during this time:

-I have completed 248 credit hours of course work and NEVER FAILED a course/ or received a ?No Report.?
-In my entire post secondary education I have completed over 500 Credit hours of course work and NEVER FAILED A COURSE, or received a ?No Report.?
-I have attended 5 (five) colleges,
-Earned 3 (three) degrees and
-All the while I have worked within the profession of dentistry
-I am a husband and father to two boys.

By all rights I should be receiving my license to become a Doctor of Dental Surgery at this moment, and were it not for the injury and torment that this individual has brought upon me in this second semester of my Senior Year I would finally be able contribute to my family's welfare.

I have attempted to resolve the issues internally and have met been met with brick walls, and increased hostility. My complaints have been disregarded and criticized. What is more, I am quite frankly terrified that this individual is continuing to endeavor to ultimately see that I am expelled from the college. I believe I am being dismissed internally, in a very large part, because of the politics of the College of Dentistry. I am afraid to seek further intervention from within the university system because of his overt hostility toward me and the fear and paranoia he invokes in others in the system; I fear that he may attempt to expel me, as he has the unmitigated power to do so, and he is utterly incensed that I was able to find my way out of the unjust failing grade and caused him the embarrassment of having his egregious errors pointed out and noted.

His actions have already cost me my graduation, caused me the loss of a dental practice I was slated to assume control over in June or July and caused financial the ruination of my family.

Please advise, thank you!

THE FOLLOWING ARE INCIDENTS THAT I HAVE DOCUMENTED AND FOR WHICH I HAVE EVIDENCE:

1) Dr."X" [the Associate Dean, and Primary Course Director] deliberately did not disclose information which was used in determination of my failing grade for periods as long as 246, days or on average, 90 days.

2) "X" denies my request to see my file.

3) After asserting that I had checked the Bylaws, "X" delivers an EDITED copy of my file.

4) "X" pulls my application to take Clinical Boards Exam 17(seventeen) days prior to notifying me of my Failure in the course.

5) "X" admits failing to use required and completed evaluations "These evaluations were NOT used and there is no other information in your file that was present on March 30 that you have received already. We can use those evals that I have received if you like but I did not use them in the evaluation."

5.5) I AM NOT NOTIFIED THAT THE DECISION TO FAIL ME IN THE COURSE HAS BEEN MADE FOR THREE AND A HALF MONTHS, DURING WHICH TIME HE CONTINUES TO ACCRUE HIS ?EVIDENCE? TO SUBSTANTIATE THE COURSE FAILURE.

6) One of the course directors states that they will be more likely to determine a duration of Remediation for the course which was more satisfactory to me if I decided not to proceed with my academic appeal.

7) "X" delivers a copy of the entire contents of my "File" to the President of the Academic Appeals Committee 9(NINE) DAYS PRIOR TO MY SUBMITTING MY FORMAL APPEAL.

8)"X" confiscates my Graduation Announcements which were ordered and paid for (by myself) through a Company independent of the school, but who delivered all Invitations to the school.

9) "X" determines that in addition to "a learning deficiency, an ethical deficiency, and academic deficiencies," I also suffer from a SPIRITUAL DEFICIENCY." He makes it CLEAR, IN NO UNCERTIAN TERMS, THAT I AM TO CALL HIM TO DISCUSS MY ?SPIRTUAL DEFICIENCY? and gives me both his home and cell phone numbers.

10) "X" insists that I go to Lincoln Premier Psychiatric Group and sign a ?Release" to grant him access to my confidential medical records, contacts them himself on multiple occasions. He wants to know what drugs are being used to treat my depression/ AD/HD. He wants to know how often I see my therapist, and what they are treating me for, and how.

11) "X" cites as reason for disallowing my participation in the Graduation Ceremony a Fictitious Document or Policy that declares that a Student who has a "No Report" grade and cannot complete the requirements of the Course in which the student has the ?No Report? within 45 DAYS of the graduation Ceremonies, the student cannot participate in said function. And he would have at least 46 days of requirements for me to complete.

Ouch, that completely sucks. The only thing I can say is to pick your battles. It sounds like the graduation ceremonies have not yet happened. If this is true I would just drop the fight to participate (I know this really sucks) and concentrate on getting the degree and getting the hell out of that school. It is better to have a degree and no graduation than no graduation and no degree. When the school sends you letters asking for donations make sure that you let them know they'll never get another cent of your money untill Dr. X is dismissed and/or shot.
 
I wish I knew what to do. That totally sucks. If you have any chance of getting your degree, do so. All the other things seem like you can litigate and/or have this person relieved of their position at that university. This sounds like total unprofessional academic politics.

I think this guy crossed some major lines. Have you spoken with the dean of the dental school? How about the dean/chancellor of the university? ASDA representatives? National ASDA officers? State dental association? ADA ethics committee? Accreditation committee? Regarding the other two faculty that backed up his decision for no report, were they possibly coerced into making that decision? If I were you I would get as many people invloved as possible. Regardless of the outcome, it would make this guy look bad. Make him accountable. It sounds like you collected and organized that evidence for a reason. It's too bad you missed graduation, but I agree, you need to focus on graduating, and if the remediation criteria is unreasonable, you need to do something about it now. Do you have legal representation? It's probably expensive, but can you think of a more important time to have some scary lawyers on your side? Do you know if he pulled the same crap with any other recent seniors or graduates?
 
I know a friend who knows a friend of a friend who happens to know a friend of another friend who can take care of Dr. X for ya ;) It'll cost u though :D

It seems like that Dr. X has PERSONAL business with u. Some of the above listed things which Dr. X had done were just ridiculous and unfathomable :confused: It's almost impossible to deal with unreasonable people.
Have you consulted w. the Dean, other professors or clinical instructors to see what can they do or advice u to do? The school usually is willing to help/work w. you when you have any problems.
If you had tried everything unsucessfully then considering a legal counsel as your last resource. If your case is legit then you don't have anything to worry about, besides money! If I were u then I would try everything possible to get my degree. It looks like that you have worked very hard toward getting your degree. It's sad that everybody can sue anybody for anything nowadays, but sometimes you gotta do what u gotta do.

What did u do to fail the ""Patient Management and Professionalism." anyway? Poor patient management? unprofessional conduct toward Dr. X or other professors? conduct of "unbecoming" a dentist? (couldn't help using that word!) because any Joe Schmoe can pass that class!

That blows man! Unfortunately the easiest way out of this sh1t is to do whatever he wants you to do to remediate the course. You've mentioned the remediation is nearly "impossible", but it is still better than battling it out. Get your degree and then retaliate. Man, I've had my share of dealing with faculty. It's all politics man and unfortunately, they have the upper hand on things and can prevent us getting what we want.

I would go up the chain of command and plead your case if you wish to battle it out. Keep strong, but sometimes, you just have to tug your tail between your legs and swallow the pride and get you sh1t done and get the hell out of there!

Does your school have an ombudsman? They usually resolve issues such as these.
 
Retain the services of an attorney and then have them serve papers to your Dean first, and then about an hour later to Dr. X.

Something tells me that with some legal action pending, your Dean may very well help Dr. X with his "spiritual imbalance"

After that when you have your diploma, goto the alumni office and make sure that in your newly created alumni file that they're aware to never evn consider calling you to ask for $$ until Dr. X is long since retired from your alma mater. (I've got such a note in my file {it's a Dr. N in my case} and haven't been called since I graduated 7 years ago, whereas my wife who was also in my class gets calls 3 or 4 times a year to donate.

The thing though that really burns me is that this garbage still exists. Plain and simple, most of the time its caused by over the hill slower than molasses, can't make it in private practice faculty who were "hazed" when they were students and as such feel like they need to haze the current students, and frankly that sucks! :mad: Stuff like this is why I encourage every graduate that lives within a 1 hour drive of a dental school to volunteer some of your time when your out in private practice and go back an teach part time. Believe me its great fun when you get to tell your former dental school instructors that they're wrong about how things happen in the real dental world today :D

Is there any way you can withdraw your academic appeal now? If so, DO IT. This piece of your post tells me you still may have a chance at getting your degree. Don't throw that away.

They definitely have the upper hand. Whatever lawyers you can afford, Dr. X and the School can afford better ones. My advice is NOT to get any more involved in these politics or try to bring in big influence on your behalf.

I agree with those above, the lawyer is probably a last resort. But there's a support system in place, if not at your school, then at least on a state/national level. What exactly are they asking you to do to remediate? Does it involve seeing patients?
 
Yikes. What a crazy situation. I'm really sorry.

Do what you need to do to get out of there safely with your degree, I wouldn't "taunt" Dr. X any further. The other posters are right, he's a jerk, but a jerk with more power than you have as a student.

Are you close with any of the politically plugged-in faculty at the school? You might be able to get some advice from someone on the inside on how to do what you need to do to most *easily* recitify this situation and get your degree -- and get the heck OUT of that place.

Nothin like getting lawyers involved in this mess. But I think here you could have a case .
 
FROM PERSONNAL EXPERIENCE. IF YOU WANT TO ATTEND GRADUATION HIRE A LAWYER. A FEW YEARS AGO I WAS AT UT-MEMPHIS AS A FIRST YEAR STUDENT. I FAILED A CLASS AND HAD TO REMEDIATE THE WHOLE YEAR. IT WAS A SUBJECTIVE GRADED CLASS. LONG STORY SHORT, I CAME BACK THE YEAR AFTER AND EVERYTHING WAS FINE UNTIL WE STARTED GETTING GRADES. DR. TuRnEr. HIS ATTITUDE TOWARDS ME TOOK A 180 AND IT WAS NOTICED BY EVERYONE IN THE CLASS. I RECEIVED AN F BY 1.5 POINTS. IMAGINE THAT SCENARIO. IN FACT AFTER THE REMEDIATION IN THE SUMMER I WAS NOT ALLOWED TO REVIEW MY WORK DUE TO THE APPEALS PROCESS. I WAS A SECOND YEAR STUDENT FOR 2 DAYS WHEN I GOT A LETTER OF DISMISSAL. I WAS IN AWE WHEN I WAS TOLD THAT I COULD NOT REVIEW MY WORK AND SEE HOW I DID NOT PASS THE REMEDIATION. IT WAS THAT DAY, I HIRED A LAWYER AND TWO DAYS LATER I WAS GRANTED READMISSION BACK AT UT MEMPHIS AS A SECOND YEAR STUDENT. I TOLD THEM THROUGH MY LAWYER TO SHOVE IT UP WHERE THE SUN DOES NOT SHINE. NOT THOSE EXACT WORDS BUT MORE GRAPHIC. IT WAS A GREAT FEELING TO HIRE A LAWYER FOR 350 DOLLARS WHO HAD BEEN THROUGH A SIMILIAR EXPERIENCE IN MED SCHOOL TO GET REVENGE. ADMINISTRATORS LOVE TO INTIMIDATE STUDENTS BUT WHEN YOU FEEL YOUR BACK IS AGAINST THE WALL DO NOT BE AFRAID TO GET A LAWYER AND LET THEM DUE THE WORK THEY LOVE TO DO. THE FUNNY THING I'VE HEARD THROUGH THE GRAPEVINE THAT DR. T WILL NO LONGER BE WORKING AT UT-MEMPHIS. KARMA IS WONDERFUL AND OH YEAH IF YOUR OUT THERE DR. CONGRATS AND WELCOME TO THE WORLD OF THE BIG ORANGE SCREW.
 
A case like this sure points out what can go wrong when professionalism is apparently swept aside for whatever reason. I tend to agree with those who recommend consulting an attorney. The problem of offering amatuer advice to Tourodont is that we don't know the whole story. Did Dr X simply take a dislking to Taurodont's personality? That makes judging Dr X's actions as unacceptable easy for me. On the other hand, what if Taurodont, while known by the school to be a married man, openly engaged in a romantic tryst with Dr X's niece who also worked at the school clinic? Would that shade anyone's judgement regarding this issue? It might mine.

I'll keep this in mind if I ever get a professor that I don't get along with in dental school. It's scary that they can have that much power.
 
That is really sad...................I am surprised how something like this still exists in schools. I hope there is something more in the story missing,because to me all this too discouraging.I feel if this is true, then all of us are actually walking on a very thin line...........I mean you know dental school is very hectic,so many people you come accoss.....and I am sure you definitely cannot keep everyone HAPPY! There are always some that dislike you or are not really fond of you and if these people have this kind of power then .......well GOD SAVE US!! Also with shortage of faculty such people are going to be tolerated in schools,I guess.

Since you have his home and cell phone numbers, post them in men's rooms. Distribute them to telemarketers. Apply to gay porn film studios and use these numbers as your contact numbers! (P.S. If you think I'm kidding or joking around, I'm not.)

Tell him you'll swap him your medical records for his medical records.
 
Groundhog, I had a similar response when I first read Tauro's post. Maybe the professor felt that Taurodont was mentally or emotionally unfit for the practice of dentistry and this was his way of "protecting" the public. But after thinking about it I realized that that was not Dr. X's prerogative; Tauro desreves to be evaluated in the same manner as the other students. Whether he is fit for the practice of dentistry is a matter for the State Board.

I think that if the issue can't be resolved within the school, he NEEDS to get a lawyer. I know I have been subject to "hazing" and unfair treatment from one professor and just went along with it like nothing happened, but this situation is too serious to play the little mind games of bitter old men.
 
Submit a bill to the school re: payment for your announcements. Ask for interest. Include miscellaneous other charges.
 
Agree to meet with the guy. Then, spend the entire meeting belching, sneezing, farting, and generally undergoing any other bodily function you can get away with, none of which is illegal.
 
Well the University of Nebraska sounds like they are up to their old tricks again. My advice to you is to retain the services of John Stevens Barry, It may cost you a few thousand dollars, but it sounds like you need a Baracuda to take on Brown and Molvar I presume. Do it right away!
 
be careful. when i read your initial post, i pick up an awful lot of anger and uncertainty. that is exactly how i would feel were i in your situation. as it stands, everything you have worked for over the last 6 years is in jeopardy. you do need a lawyer. however, you also need to curb your emotions from this point on. alone, you will not win this battle. the more you try, the more emotion you show, the more ammunition you give your opposition. the way it sounds to me, you arent graduating right now. youve sent your appeal in, and thats all you can do. get your lawyer, and let him take care of all your correspondence with school brass. whatever took place in that class, it didnt sit right with dr. x. Dr. x obviously does not think you are prepared to be a dentist. familiar with the miranda rights? "you have the right to remain silent, anything you say can (and will) be used against you in a court of law." time to be silent. let the lawyer talk. consider the money you pay that lawyer to be another dental school fee. i'd hate to spend all that money on school and not spend the extra couple grand to actually graduate. good luck...
