I am looking at my notes I took from my training program for working in pharmacy... I work in GA btw, and I'm hoping you can correct me on this:

1. You must be 18 to buy PSE containing products(i.e. Claritin D, Mucinex D)

2. You must always present a valid ID. My question here is also what type of IDs are valid?

Federal law says that one must be 18 to buy ephedrine derivatives OTC as of September 30. A person of any age should still be able to get them by prescription, so long as state law allows.

For OTC sales "valid ID" means current photo ID that is unaltered and government issued. The DEA says it can be state or federal. There is no mention about whether or not foreign passports or tribal IDs will be honored.

In pharmacy....the strictest law always trumps the least strict law. So...if your own state requires a valid state license....thats what you need - no matter what the federal law requires.

CA's law went into effect in April - we just need a photo ID with a valid birthdate. A passport will work, but a Mexican ID card will not since they do not have the birthdate on it with a photo.

Easy enough to forge, however.....which is done all the time, I might say!

On top of the HIPPA bullshi+ we deal with every day, on top of the Med Guides we are forced to hand out assuming patients actually read this crap, we have to log every single person buying sudafed like it's a damn crime. Absolutely amazing! And how are we compensated? oh yeah...goes with the job responsibility. No reimbursement for that! Oh yeah and another thing, that also makes me in charge of the inventory for all sudafed containing products! whooptie freaking doo! AGHHHH stupid governement

oh yeah, and has anyone noticed that the DEA's guide talks about PPA??? what a bunch of *******es if I say so myself!

Less meth = fewer meth babies. One of my patients has devoted her life to caring for kids born addicted to meth. They have some very special needs and odd behaviors that don't go away after they detox. This restriction is not just about protecting people from themselves, but about protecting the people around them and society as a whole. It sucks that it has to come to this, but pharmacists are gatekeepers. If everything were freely available, our jobs would be radically different.

Blame your employer or state government for choosing you as the salesperson. The federal law does not say behind the "pharmacy counter", it says "counter". One local store here puts the ephedrine derivatives at the customer service desk with the cigarettes. As long as the store maintains shelf tags, trains employees, and follows logging procedures, the ephedrine derivatives can be sold from any secured counter unless your state law is more specific.

PPA is still available by Rx for vet use. I assume they just want to keep drug companies from pushing for bringing it OTC by including it in their legislation.

I will add a rant. This shelf tag maintenance BS reminds me of OTC outdates where pharmacy gets in trouble for lack of compliance although few of us are actually allowed by our employers to participate in these activities.

I don't know about other states, but in Oklahoma, come Oct 1, every time you sell PSE, you have to go to the computer, log onto the OSBN website, type in the purchasers info (DOB, DL #, Address) and how much they are purchasing. The website will then tell you if the person is allowed to purchase, if they have gone over their 9 gram a month limit or whatever. I think that this is a really good idea, but to sell a box of Actifed, it's going to be a pain in the ass. But I have so many crackheads that come in my store, I would LOVE to tell them, "Sorry, I can't sell you any PSE. " Heheheheheeeee.

For some reason I think the bad guys can easily bypass the system in GA. It seems like our data base is localized. So for us we log who bought PSE, but theres no regional database that combines all this information(atleast from what I think). So all the PSE buyer information is isolated at each different store, and a customer can then go from store to store to buy more PSE.

And I dont know wtf is up with me these days. It seems that everytime someone complains about the PSE limits, I have a tendency to question them in my mind that they are trying to produce meth. Its like "yea your over your limit you meth producer."
