"Do you wish to be considered for in-state tuition status?" question on supplementals

I'm filling out a supplemental for Maryland and they ask the following question: "Do you wish to be considered for in-state tuition status?". I'm OOS but if I'm accepted and decide to go there I do plan on moving there and trying to establish residency but that's only for the second year (my understanding is that first year is basically out). Am I correct in assuming I should select no to that question because right now I'm OOS or do I select yes since I'm intending to apply for IS at some later point?
Same question applies to other OOS schools that may ask this question.

Thanks. Is there an opportunity at the end of every year to apply for IS tuition for the next? Is that how it works?
