Easy to get a criminal record: How I went to Jail for "STUDYING in the library"

This forum made possible through the generous support of SDN members, donors, and sponsors. Thank you.
Wow....maybe you can add a twist to this and say that you were so devoted to your school work that you got arrested for it?

I kid of course, but wow, sorry to hear you had to go through that. It's ridiculous they would do anything more than fine somebody for illegally being in a library.

So you were sitting at a desk in a visitor friendly library studying, and randomly all chaos breaks loose, and you get arrested? (despite the previous "sleeping in the library" comment, which 1/4 of the library using world does).

There's got to be another side to this story.

Or maybe it was the just bitter old librarian who hasn't gotten laid in 30 years

here is the story:

Well, she was like "this is just one new thing...i am going to call the campus police". I had to stay focused on my goal ie my final my grades. So i went back to my desk. The campus police came and couldn't locate me b.c they didn't know what i looked like. Well i told them that this is me and the officer lady just gave me a criminal citation warning and told me to not come back again (or else i'll get arrested_i wasn't sure that she meant by that but w/e) and leave immediately. She escorted me from the campus. Wtf? Hello. But again she even said that if i didn't leave, she would take me to the county jail . i was crying etc.

lmfao

thanks for posting this, stupid app cycle had me very sad until now i cant stop laughing

Wow. Sorry to hear that... Just out of curiosity, what would one do to complain about such a matter? I mean, assuming I read the story right and understood all of the presented facts, you were not exactly at fault here.... so what does someone do to complain? Would the countermeasures involve going outside the jurisdiction of the academic institution?

So... you violated what seems like several library policies and they issued you a citation, complete with a statement saying that if you returned that you would be arrested for trespassing. So you returned the next day and got arrested, and it was somehow unexpected?

You're right, you do have a lot of studying to do.

Oh, and leaving your **** all over a table for hours during exams in the library when you're not there, even if not against library policies, is really rude and annoying. Especially at a university library. Especially when it's not your own.

I'm with Bluvip. Going to bed smiling.

Here is the story:

I have been using the library (which anyone can enter and sign in using a valid Photo ID) for 4 months. I go there almost every day to study for past 4 months. Often times I would go there and then get up to go outside to get lunch or snack or take a walk. I have a lot of studying to do (HELLO!!!) and often stay there for hours. I think the library staff got passive-aggressive at me (ie. the front desk people the workers etc) b.c they had to push some extra chairs, or something. Or when I would return to the library, they would have to find my name and sign me in again in their roster. So maybe they were just annoyed there. A couple of times they had to tell me to not bring or eat food on my desk. Fine. Hello. A few times during finals weeks, i left my books on the desk and then went to sleep at home for a 6 hours or so. Sure you are agitated, maybe, but hello, that is not criminal?

Then the sleeping over thing happened. I told that lady in front desk that yes, this happened and I'm happy to talk to all parties but I have a final exam in 1 hr and I have to go now. Can you please give me back my study materials? I had gone to sleep in a different part of the library and they just cleaned up --many library pick up materials left on the desk after morning swipes etc.

Then the next day I went and talk to the police head guy who said that he'll lookinto the matteR. The next day I went there to do my work. I was sitting on a desk and the offier comes and hand cuffs me and takes me to the JAIL.

Yes I was in the wrong to have gone to campus when they told me not to. The reasoning may have been personal bias, and no reasoning at all. but its' private property even if it's a library. And I think the librarian front desk lady must have said not good things to me to the officer, blah blah ____ insert [!!#$#$@$#@#$@]

Long story short: Stay out of silly people and their silly stuff . If they say don't come back, then don't until the matter is resolved and you have written permission. Bad things can happen and we all have more imp things to do with our times. The district judge court and lawyers also have better things to do with their time, like FIGHTing other more lucaritive crime (drugs/ marijuana, DWI, theft, homocide, violence, etc). Also, sometimes they are happy to prosecute!!!!

You said "Hello" in your story like 9 times 😎

And although I hate it when libraries and other public places think they rule people, it seems like you were mostly at fault here.

+1!!!!! I always think if no one comes in a few hours I'm putting their stuff on the floor

Honestly speaking, you had it coming (but you already know that). Be considerate of the resources you use, the library staff wouldn't have been so pissed if you weren't constantly being a inconsiderate pre-med. Hello! Follow the rules. Sorry... I had to.

i guess the other thing is that this is not my undergrad or my own institutions's library. if i was a student in their univ, they can't give me $hit for it.

And these are maybe common courtesy rules, but HELLO, it is not like I signed a contract that stated this.

The library may be pissed at me, but perhaps there are far more civils and more-tax payer dollar friendly ways of resolving this . This isn't criminal and the lawyers in the court were like #@$#@$@$#@$@ this isn't a criminal case, but I do know that they got me for "criminal tresspassing" b.c that's all they could get me on, but the real reason was all this other biased crap. Deep breaths...

I don't even want to discuss this with people that can't tell the difference between "criminal" and not following procedures.

The librarians may have been annoyed but it's still wrongful arrest if the reasons behind it aren't criminal. Criminal = theft, causing damage to the property etc, but I guess that most of you guys don't know much about criminal law anyways.

In other words, you don't want to discuss this with people who disagree with you. Okay.

They did. They gave you a warning and told you not to come back.

To add onto dpsPanda's post, the basic definition of criminal trespassing (land):

Entering another person's/entity's/institution's property against the wishes of the person/entity/institution.

http://www.judiciary.state.nj.us/criminal/charges/crimtres1.pdf
http://blackslawdictionary.org/trespass/

Sounds like your situation fits the letter of the law.

haha oh omg. go to the local news imo. maybe enough people will talk smack about the librarian to get her fired or suspended

I read every "hello" as

Using a library at a school you don't pay tuition to...

& getting upset when they're irritated with you acting like you own the place...

I mean, HOLA! Classic annoying-little-brother syndrome.

Seriously, should have just said "I'm sorry. My name is pre-Dr. Orangblue. I meant no harm. Here's my card, free flu shots!" Everyone likes free shots.

+pity+

You said "Hello" in your story like 9 times 😎

I just came to say hello, hello, hello, hello

I heard so many cons tell their version and later discovering the whole story that almost never believe them anymore. Of course I can't observe your body language or hear you as you would say it and maybe you part of the few, but considering librarians and campus cops were involved I must say the balance of probability does not tilt in your favour.

OP should have rambled about this was unconstitutional.

Then this board might have been interesting. Law is always nice to debate. =D

Honestly OP, you should have just taken your stuff and left when they told you to not come back. The re-entry was indeed trespassing, and they can charge you for it.

Besides, that can't be the only library near you, right?

Librarian 1
self-centered ass 0

The only thing the library did wrong was not confiscate your crap and put it on ebay when you selfishly left it there.

I don't mean to be insensitive to your situation, but honestly, you type like a 14 year old girl.

You're sense of entitlement and lack of insight is impressive.
👍

This sums up my thoughts. Yes, being arrested for going to the library sounds excessive. But this could have been easily avoided at a number of turns. Long story short: You pissed off enough people with lots of minor things and they finally got fed up with you.

You study this hard for pre-med? Someone needs to show you a little balance.

I don't mean to be insensitive to your situation, but honestly, you type like a 14 year old girl.

LOL!

Now, why did you have to add the world girl at the end? We're not talking about boxing, here and, on average, 14yo girls write better than their male counterparts.

ITT folks are not interested in discussing the nuances of criminal law. You've put yourself in the stocks, now we hurl tomatoes at you. This will last for several days. 5 pages.

Congratulations on becoming the Ronnie Dobbs of pre-meds.

LOL, well I was definitely thinking the OP sounded like a girl as well. Over-use of "Hello!" made me think that. But, just as there are probably boys out there who dot their "i's" with little hearts, there are probably guys who type like that

Scrap my last comment. After re-reading I agree, but will have to adjust the age to 12 ± 2yrs to compensate.

Funny story. Either you are trolling or you dont have common sense.

It's probably the latter. I knew many people like him/her at the University. Extraordinarily bright, entitled by brains or money or both, but seriously lacking common sense. BTW, lack of common sense is not really compatible with a career as a physician. 😉

You actually need more common sense than brains.

Fina, guys and girls: Hurl the tomatoes since you don't have anything self for self-pleasure. This wasn't the intend of my post but ok/whatever/Iforgot that This Is SDN not a community of smart people.

Yes, I agree that I was indeed trespassing even if I thought that reasoning to tell me not come back was completely BS and not justified.
The reason was "cop" was involved because I got a security guard who (it was a she) was just very bitter and biased. So she did what she could in her power.

The library staff should have told or given me a warning(that's again a more friendly way to resolve this conflict) that taking up everyone's time and taxpayer dollars in court where it was dismissed in <5 mins. The Head of Campus Police didn't want it to happen nor did the other offices that actually took me jail since the "arresting officer" was off.

But I forget, this is SDN.....where people are happy to throw tomatoes instead of having a productive discussion.

You don't always need "common sense" to be a doctor or any kind of specilized niche professional skills. What you do need is to be very very good at your job, skills, knowledge..... after that, what you do in you personal life is your business. Of course, there can be some spill-over effect, but generally people who are very smart, bright, intrigued by their profession are able to compensate for that.

wtf is logic lol

So you agree that you were trespassing, but because "their reason was BS" you think you're exempt?

The library staff did give you a warning. They told you not to come back.

You said yourself you were given a warning.

This! I was thinking Lionel Ritchie as well.

In all seriousness, you can't just leave your stuff on a table in the library, because it is really inconsiderate for the other students in the whole school. Yes, you are not the only student that needs to utilize a desk in the library. And if you know the policy is to not eat or drink inside the library, why would you do it? Hello!! Ha.

You may be book smart, but you seem to lack a sense of social commonsense. What I mean by that, is that you have a lack of care for others around you, or rules that you need to abide by. When you screw up and told not to go somewhere ever again or else, and you actually go, what do you expect?

It's good to study hard, but that shouldn't take away from being a good person and following social norms.

Hey, it could happen to anyone. I'm afraid to go to library's now. OP- consider your sage warning heeded. 👎

Not if that lack of common sense results in a criminal record...

Sure I agree with that . But the main point of my post is distinguishing between what is criminal and what is not, and that there are far better more sophisticated ways of resolving this conflict. I am in communication with the Head of the Campus Police and Head of Librarian.

Yes, it's bad and not good for social norms, but this was FINALS week and everyone does that in finals week. HELLO! Yes, you can ping me and get mad, but it is not a criminal offense. That's the whole gist of my argument here.
But I FORGET This is GOING TO BE A SILLY threat b.c THIS IS SDN!!!!!

HELLO!!!

The reason the officer gave me for trespassing was related to incident of "sleeping overnight" when in reality the library is also suppose to announce and check before locking down the building esp. if they are closing earlier than usual. Again, just lots of BS that I don't have time for.
