So, I currently practice in NY but I'm studying for Maine's MPJE and going over exempt narcotic preparations. This provision sounds insane to me coming from NY where benzos are treated like CII and other unique stringencies. Do pharmacies where this provisions exist really sell bottles of Lortab solution and the like OTC? Can I really stroll into a pharmacy, slap down my ID and walk out with a bottle of opium tincture? sounds like a magical place
 
One of my coworkers went to Maine for vacation and bought some Cheratussin OTC. Brought it back to work to show us and we were all freaking out.
 
I have no idea with NY - but Lortab is a schedule II - so doubt it - the schedule V's? I know several pharmacy that have sold them in the past. Once I was back home in Illinois over Christmas break (where I used to practice and know it is legal to sell) - I felt like a drug seeker trying to find someone who sold it with out a RX. Several times I was told "it is rx only in this state" Then I had to call them out and say I am licensed here and know it is available OTC if you are willing to sell. I was trying to avoid an out of network urgent visit when I got the flu. Finally found a local independent that sold it for $3 for 4 ounces
