Independent Contractors-NY

I'm looking to hire an independent contractor (in NY) who is an LMSW. I have a call in to speak to an attorney, but my understanding is that since she is an LMSW as opposed to an LCSW she would need to be hired as staff. Any work arounds for this?

I chose to just set people up as employees and use a payroll service for that. It really isn’t that much work and then I don’t have to worry about it.
