Is this legal?

There is a dr that doesn't like cvs and wags. If a pt brings in an rx to one of those locations and they fax him to get refills, he denies it saying I don't use cvs or wags and says for pt to call office. Pt then calls office and office tells them to go to independent XYZ but if that is not close then go anywhere but cvs or wags, then he will ok refills. Is this legal?

Dr has no ties to XYZ except that he thinks supporting local independent is better than feeding Corporate beast.

I don't blame dr, I would be annoyed with all the faxes to switch vytorin also, however someones insurance only works at cvs, so pt is pissed.
 
My guess is that it is legal, but not a very good business practice. He will probably lose a lot of patients if this becomes a major issue for the patients. I am anxious to see if someone knows the law and actually knows if it is legal or not.
 
I'm guessing it's legal as long as he is not getting any compensation from the pharmacy for sending patients their. I imagine compensation could anything from cash per customer to referring patients back to the doctor.
