Great! But what does that have to do with the Trump Justice Department going after Yale three months before an election for the same exact thing that is already the subject of litigation? Absolutely nothing to going to result from the "court ruling" @proudofmykids is referring to before the election. William Barr doesn't like "discrimination" against Whites (and Asians) and Yale isn't changing a damn thing in response!

Also, what makes you so sure the Supreme Court will be so anxious to hear this case? It's not automatic, you know? They only hear what they want to. This could be over after the appeals court ruling.

It’s just extra detail around the lawsuit, case status, and goal of litigators for context given that you made it sound like that case was done and zipped, which is inaccurate.

For the Supreme Court being “likely to hear it,” I’ll admit that’s a bold claim. I would say that given it’s major publicity as far as court cases go, it is more likely to hear it than just a random case.
 
Knightdoc is correct it is a Department of Justice finding.
However, the DoJ is independent of the executive branch despite the AG assignment.

There are literally three branches of government: executive, judicial and legislative, and DOJ is LITERALLY part of the executive branch. While it has traditionally been allowed to operate independently, if you have been paying attention at all you'd realize NOTHING has been operating traditionally since January 20, 2017! How has your mail service been for the past few weeks? :laugh:

Yes, I think we are saying the same thing with respect to the DOJ finding. I'm saying it has nothing to do with anything because there is already a similar case in the courts. Yale would be ignoring Justice with or withouot the Harvard case, so the DOJ case is literally pointless, other than to gnerate publicity for Trump's platform to "Make America Great."

Publicity has nothing to do with anything when it comes to the 70 or so cases the Court agrees to hear each year. Everyone thinks their case is the end of the world. This is not that big of a deal, given the number of similar cases the Court has heard over the years. The law is very well settled. Schools are allowed to use race as a factor in admissions. This isn't controversial, or widely unpopular. This also isn't Roe V. Wade, and there is no great national desire to force institutions of higher education to deemphasize diversity in admissions, even though it's a hot button issue for universities, med schools, and applicants. The appellate court is going to let the present ruling stand, given where it's going to be heard (MA), and the Supreme Court is not going to waste its time with it.

Justice is just doing Trump's bidding. Whatever case they bring will very likely be dismissed sometime after next January, as the new administration will have zero interest in pursuing it. Otherwise, Yale will be forced to spend some money to defend what it is doing, but will ultimately receive the same exact outcome as Harvard. The DOJ isn't adding anything at all to the matter, which is already pending. That is why it's irrelevant.

DOJ was independent before 2017???? Haven't you heard about Bill Clinton meeting then-Attorney General Loretta Lynch on the west side of Phoenix Sky Harbor airport?

Sure it does!!! :laugh: The Harvard case will be eligible years before that, and it's highly unlikely the Court will have any interest in that case either.

Do you have any idea what percentage of DOJ cases are heard by the Supreme Court? It's close to 0%!
