No refills on control script written by Texas mid-level practictioners per DEA

I work for a major retail chain in Texas. My supervisor recently notified us that mid-level practictioners (MLP) can only write up to 90 days for controls and the script expires in 90 days from when it was written (http://www.tmb.state.tx.us/professionals/2009PrescriptiveDelegationChanges.pdf). Previously, we were filling up to 6 months for all control rx. I don't think anyone I ever worked with knew of this law.

We decided to check with the DEA regarding MLP script authorities and they indicate that Texas MLP cannot write refills on control rx (http://www.deadiversion.usdoj.gov/drugreg/practioners/mlp_by_state.pdf). We have been calling on all control scripts written by MLP that contain refills. When we refer MLPs to the DEA, some just refax us rx with the MD signature on them but still contain the same refills.

For those of you who practice in Texas, have you questioned this discrepancy before?

I've always did a refill not to exceed 90 days.

Its Texas, the prescribers do what ever they want. They live in Texas by God the laws do not apply.

We have been filling the refills also but we weren't suppose to. Also the script expires in 90 days, not 6 months.
