There is more of a story to this, but basically my question boils down to this:

If I was convicted of a misdemeanor, completed probation for it after which the offence was expunged as agreed to by terms with my lawyer and the prosecutor, do I have to report this as a misdemeanor on AMCAS?

If the answer is yes, would you?

I would follow the directions...if it says that they don't need to know about it if it meets the following conditions, and those conditions are met, then you don't need to put it down. gl
 
I think you don't have to put it down if it has been expunged. If I'm wrong, don't lie to them.

If the application asks whether you have been arrested or charged with an offense you should list it. Because, you were arrested. But, you can say the charge was expunged from the record.
If the application asks if you have been convicted of an offense you can say no.

Generally no. But, the laws are changing and vary from state to state. If it is a minor offense, probably not. A felony, talk to a lawyer versed in that particular state's laws. I hope that helps.

AMCAS specifically says you do NOT have to report anything from when you were a minor...it says right there in the application

This is basically what the lawyer said. I think its clear that AMCAS would still require it to be reported, but once that is done the entire explanation would be pretty awkward and defeat the whole purpose of having it expunged in the first place. And no, this wasn't an offence when I was a minor.

Now the real question is, would you report it and risk a comittee member find out the fact that you had a charged expunged. Anywhere down the line. Med school app, residency, MD liscencing... can this come back to hurt you?

So your real question isn't whether or not you are required to report it, the real question is what happens if you get caught lying?

Follow the directions to the letter and you are safe. Ignore the directions and if you get caught, you've compounded your problems. You would have been the applicant with the uncomfortable explanation for a clean record; you're now the guy with the clean record who lied on his application.

Just do what the app says. Any deviation from that is dishonest and can bring about bad juju.

No, you don't need to report it. The AMCAS question specifically excludes convictions which were expunged.

I actually read that part of the application and missed it - just goes to show how nervous I was.

From searching previous thread I see that this comes up year after year, about expunged charges, even some questioning if they can find out what was expunged with a background check. It's Good to know that AMCAS has a definitive guideline for this in the application. 😎

If any schools use a private backgroung check company (vs. just running your record at the local govt center) then you will probably need to report it. Expunged crimes will not be considered during future criminal proceedings and, thus, they are taken off your official criminal record that the govt has. Private companies don't have to take anything off their books (they buy the records of charges/convictions/etc from the courts every day), so your actual record will always be on some database somewhere. I wouldn't lie about it. Is it a trivial offense that they might not even care about?
 
Ha I was charged with a misdameanor, paid a lawyer 1500 to get witheld ajudication and the charge expunged off my record. All I had to do was either pay the court $100 or do 100 hours of community service. I chose the former and had no probation. However the police violated one of constitutional rights and that is how they arrested me. I didnt put it on my amcas and I am now starting MS1 at Downstate.

Except that AMCAS explicitly states that they do not require it, so it doesn't matter whether they can find some obscure private record of it or not.
