Received this e-mail yesterday from my local pharmacy association back home in Florida. I was busy at work today, so didn't get to give them a call and find out what the heck they were talking about.

Anyone know what's up? Obviously I'm out of the loop...

Dear Colleagues:

I'm sure you are aware of the infamous legislative draft from the Department of Health.

We have pressing, time sensitive information about this proposal from the DOH that we feel is important to share with the general membership.

We're asking that you ask your members, wives, girlfriends, boyfriends or anyone else interested in the profession of pharmacy to convene and listen to the information.

We will meet at the Terry Building, School of Pharmacy at Nova, a place that is centrally located to Palm Beach and Miami-Dade Counties to discuss this draft. We will start at 7 p.m. and propose 1/2 hr to explain the issues and devise a plan.

On behalf of President Bert Martinez and the FPA, we urge you to convince as many as possible to attend or send a representative.

The Florida Dept. of Health is contemplating changes to FS 465 that appear very disturbing to many of us. The leadership from the West Palm Beach, Broward and Miami-Dade County Pharmacy Associations have been invited to NSU to discuss the issues that will be proposed by the DOH to the legislature in the next few days. You are urged to attend and participate in the discussion. The meeting scheduled for this Friday 11/19/10 at 7PM – Terry Auditorium.
 
FS 465 I think deals with prescriber dispensing.

I don't think it's that significant.
 
It's actually very scary stuff!

Here is a quick abstract of it from the CEO of Florida Pharmacists Association Michael Jackson (I know, same name as the king of pop, no relation), and here is the link to download the pdf of the actual draft language

Line 22 - Pharmacy owners will now need to post a bond when applying for
a pharmacy permit. Could add to the opening costs of starting a
pharmacy business. The bond may not be expensive unless there was prior
disciplinary action.

Line 49 - Reinspection - Who pays for the re-inspection?

Line 51 - Rx department manager required to be on site for 20 hours each
week. Does not seem to have any room for exceptions such as vacations,
family medical leave, sick leave, military call to duty etc.

Line 55 - If a permit does not operate for 10 days it must be
surrendered. Draft does not seem to allow for exceptions such as
natural disaster, extended relocation of the pharmacy, sudden death of
sole pharmacist owner/manager when the non pharmacist owner partner is
actively seeking a licensed pharmacist to replace etc.

Line 77 - 89 - Some of this language is good however it gives the
authority to non pharmacists to tinker with the clinical judgment of
practicing pharmacists. I like limiting the ownership of the permit to
only Florida licensed pharmacists though that language will never stick.
Businesses that are operated as an LLC or privately held large
corporations that are not traded on the stock exchange will not be able
to get pharmacy permits.

Line 186 - Requires Rx Department manager to complete training defined
by law. Recommend that Board of Pharmacy be granted rulemaking authority
on what that training should be. This may make it harder for some
pharmacies to recruit pharmacists to be PDMs.

Line 209 - Looks like the number of years required to keep Rx records
(and possibly purchasing records) increases to 4 years. May third party
plans and Medicare require records retained longer than 4 years though
purchase records may be a challenge.

Line 213 and 216 - Big increase in permit fees

Line 224 - 226 - Like this. Requires MDs in pain clinics to use tamper
proof Rx blanks

Line 234-247 - Big concern. Gives the Department of Health the
authority to revoke or deny initial licensure for dispensing or other
related errors.

Line 273-276 and beyond - Requires wholesalers to report transactions to
the prescription drug monitoring program. DOH says that the wholesalers
are good with this but I have not heard from them. If you transfer
drugs to another pharmacy you have to report this.

Line 604 - New licensure fee for pharmacists. You will now need a
permit to dispense controlled substances.

Line 641 - 653 - Confused by this section. It seems to require a
pharmacist dispenser permit for every location. Unable to determine how
this would affect floater pharmacists. Would they require a dispenser
permit for every pharmacy that they work in?

Sounds like they are trying to crack down on all the pain pill pharmacies. Dr. M can confirm but Florida has a hugh problem. Go to Youtube and do a search on Florida pharmacies. They had some under cover video going into these little more than hole in the wall pharmacies that were packed with people just getting pain meds filled.
