There are a few other threads in this forum that address this issue. A better question, IMO, is whether or not it is ethical to do so. And from that point of view, remember that it's a textbook and reselling, loaning, or giving away textbooks has a long and glorious tradition.

Jensen has taken the bizarre stance that even giving it away is a terrible crime. His claim is that he's selling a service to the original buyer only - ie, coaching and guidance, not just a book.

Well, I paid my money, and I got a bunch of pages with words and pictures on them. I've never spoken to the guy, and I have no particular desire to. In August 2009, when I'm notified of my passing score 🙂, you better believe I'm going to pass it on, one way or another.

Don't be afraid :scared: to sell something you have legally purchased. It's unamerican. (Still, might be best to do so discreetly, if only to avoid getting hassled by Jensen's oily minions ... eg, by PM through this forum rather than an ebay posting.)
 
My understanding of the law is that provided there is no laws prohibiting resale of an item to an individual (i.e. reselling a firearm to a felon 😱 or reselling prescription medications 👎, etc.) that by law you retain the right to do as you wish with private property that you own, not limited to selling or giving it to people.

There is a specific name for this right, I just can't remember what it is... Unless you sign a contract expressing a consent to limit the spread of the information I don't see any legal boundaries from selling. Jensen may try to make it harder but I don't think he can legally stop you... 🙂
 
On that note, now by some miracle I have passed the boards, does anyone on here care to purchase big blue?
My reward is the whoping fee of the orals wchich are registering now, and I wish to contribute to this by selling big blue and moonlighting at McDonalds........

Selling copyrighted material cannot be stopped by the original copyright holder. This is known as the First Sale Rule, which basically says that if you bought or were given a legal copy of copyrighted material, it is yours to sell or give away as you see fit. Things you cannot legally resell include: 1) illegal copies, e.g., if you just photocopy Big Blue, and 2) teaching editions of books (the free copies that teachers and professors are often given for evaluation. These are usually stamped, "free copy, not for resale" all over the cover).

The argument that you cannot resell Big Blue because it includes coaching is groundless. If one were to call Jensen for coaching, he could choose not to give you coaching unless you bought an original copy, but when you sell Big Blue you are not selling the coaching, you are only selling the book itself.
 
Despite it being legal to resell books, Jensen has made it much more difficult by forcing original buyers to agree to a bunch of terms, which include not reselling the book, or even giving it away! It is debateable whether these are enforceable, especially if you are not the original purchaser (since as a recipient YOU never agreed to this), but it has created enough red tape that I think he is able to keep the books off ebay (at least until someone challenges it).

That being said, anyone wish to buy a new, unused, unopened original Big Blue purchased 1/2007? Original price was $565 + shipping. I'll sell for half, with free shipping. $280. Email me at [email protected]
