Some of the Anesthesiologists at John Muir Walnut Creek received a 2 or 3 year Sign on bonus but they have only been with the group 1-2 years and Envision is resigning and leaving the area. Envision is now attempting to recoup the Sign on bonus...is this legally possible in California?

Yes they can. It happen to a new grad when envision left a practice (1 year into a 2 year 50k sign on bonus) and they made him/her pay it back. But he/she got new employer to cover repaying the pro rated bonus

Does anybody know if Aspen Surgery Center on the John Muir campus is still MAC/Envision, if their docs switched to Vituity, or went completely independent?
I am assuming it's prorated? So if you got 50k for two years..and the group blows up after 1 year..they want 25k back?
So..if it was a private group that dissolved...do you think the old group would still pay out the bonus afterwards?

I would imagine it’s illegal for a company to withhold salary in an attempt to recoup a signing bonus. They can then ask and you can say no, at which point they would have to sue you for it. Check the language in the contract and consult a lawyer to see if they can actually recoup the signing bonus. I imagine the laws are on the employees’ side…especially in CA?

The thing that sucks is you eat those taxes on the recouped portion since it isn't deductible.

And trust me, the wording is there. This is one of those situations where it probably IS a good idea to have a lawyer go over a contract with you. I guess a way around would be to work at one of their other facilities to fulfill the contract, but is that hassle worth the bonus money? That's the question. That's why I always advise to take those sign-on bonuses and put them in a CD or money market account until the obligation is fulfilled or otherwise.
