2013 has been a bad year for me with the law. I accidentally got in trouble for theft of a $5 face wash which I had in my front hoody pocket because I had my hands ful with items and I checked out and forgot that item. Basically here in a month I will have my final trial where I will be on house arrest for 2 weeks and have the first degree misdemeanor charge of theft on my record.

They said I could get it POSSIBLY cleared in a year, but I'm wondering, how will this effect me getting a job in retail? I'm about to finish up my third year here in May, I'm not getting kicked out or anything because I was upfront and told them day of and could tell I didn't mean to. Thanks.
 
No, that's literally all it was, I have no reason to lie about it on a forum. I was truthful with them too and they still wanted to press charges on me. The lawyers here said this court over does it on any kind of theft, I'm fine with the consequences but I'd have appreciated it if they changed the charge to something less.

A first degree misdemeanor for a $5 item? It doesn't quite make sense. Baring any extenuating circumstances any competent lawyer could have had this reduced if not completely dismissed.
 
I heard a nursing student who was working as tech stole a bunch of merchandise from the store. She was about to graduate too, so sad.

How? You can't work as a pharmacist in Iowa or Illinois if you have a non-expunged felony on your record.

I agree; there has to be more to the story.

I am somewhat skeptical that you know multiple felon pharmacists, I have to assume it is a rare breed. 😛

Are you stupid to continue with the assumption that their is more to the story when I told you I have absolutely NO reason to lie to a forum of random people??? Plain and simple theft is theft. Steal a pack of tic tacs, theft is seen as theft.

Would it make your life easier to answer the question if I told you stole 20 PS4s and robbed a bank and STILL came to you about STILL being in school I just now have a theft charge on me with 14 days house arrest???

That sucks! Self knowledge is the key. Meaning I am a flake and could see that happening to me which is why if my hands are full I stop and get a basket. Don't mean to rub the hindsight in and I am sorry. I can't believe they took it so far. WTF?

Apparently Target was highly criticized for using a blacklist database for hiring purposes that included exclusion of candidates with alleged shoplifting misdemeanor convictions. Not sure of the current status of that practice is.
 
This is so hard to believe. Half of these people work for companies which pretty much have a policy that you are not to stop shoplifters. If this is actually what had happened, it would be pretty easy to show you made other purchases right then and did forget to put in the face wash and make restitution. Something else is happening and you don't want to disclose it which is fine. However, this will come back to haunt you as retail pharmacy will look at your past record.
 
I love the insight from medical students and people listed as non students but someone who actually works for retail would make more sense to hear from rather than just opinions from some over achieving gunners that make it sound like I won't ever have a job. I'd still like to hear from someone who knows what they're talking about on the fact that it can possibly be cleared a year from now and the effect it will or will not still have on a job process.

Like can I get request an official record from the judge or someone that states that the item was something that's less than $10 and not something excessive to give to future employers?

I still don't understand how brick headed some people are to think I'm hiding something from anonymous members lmao

I love the guy who can't take the insight that no one is going to believe his story ever and can't accept the fact he is likely effed as this story is so unbelievable (even if true) that people will think he's lying to cover something else up. (BTW worked retail and went to pharm school prior to being a med student).

I agree with A4MD. Get it sealed or expunged. No reason your future has to end over this. BTW this is coming from a retail RPh, if that automatically makes it worth more somehow.
 
no way this is true. are you sure you didn't leave out the part about punching out the guy who stopped you for shoplifting, hopping in your car and speeding off and running over the 80 year old lady in the walker? the dumbest lawyer in the world could have gotten you off especially if you've had no prior arrests and it really happened like you said. did you forgo your right to an attorney and represent yourself? hell, even the dumbest person in the world representing himself would probably have gotten a lighter sentence.
 
Most retail stores DO prosecute for any shoplifting, and it doesn't matter if the person has bought stuff and just happened to "forget" 1 item (just like there is a rare person who really did drop their medicine in the toilet, 9 out of 10 times its story, and its the same with shoplifters who get caught can claim they just "forgot" that item. Too bad for the rare person who really was dumb enough to keep her/his medicine next to the toilet, nobody is going to believe their story, even if it was true.) I mean really, who sticks something in their front pocket before they buy an item...did the store really have no carts or baskets? So I have no doubt the OP was prosecuted for shoplifting, even if he really did happen to "forget" the item.

Still, I've never heard of 2 weeks house arrest for a first offense for a $5.00 item or house arrest for any misdemeanor for that matter (other than drug possession, , where the goal was to keep the person away from their druggie friends.) So I side with the "there has to be more to this story", either that or the OP had a lawyer who hated him & hung him out to dry, or the OP represented himself and was a loudmouth who insulted the judge or something.
 
I want to update you all, after I got my expungement of my house arrest and misdemeanor in early May, I was declined my job offer and I asked you guy for advice... to get some snooty ass opinions and remarks.

And a lot of you told me I wouldn't be able to get a job etc etc saying I was lying to a forum, also did't believe that my vice dean low key screwed me over, and whatever else. I appreciate that because I (easily) got four job offers after and passed my boards today (monday). It feels good because I spent probably 30% of the time you all did studying in pharmacy school... was just sleeping in class, or plain skipping classes, some other things I shouldn't mention, got the misdemeanor, got the house arrest, and I still did what you all nerdy gunners were putting me down for lmao. Basically shove it and you're gonna have a """"felon"""" as a co-worker maybe, is all I want to finally say :~)
 
Well, good for you. I don't think anyone here is concerned with having a *reformed* felon as a co-worker (although, apparently your crime was a misdemeanor?) Nobody here was being snooty, we were just being honest with our appraisal of the situation......to the best of our knowledge. Obviously, there are many job variables (I am willing to venture a guess that your 4 job offers weren't in NYC for example) It amazes me how many people who ask for advice, really don't want an honest answer. And since you apparently didn't like our advice....well, it was free, ya gonna get what ya pay for, ya know what I mean?

I know a guy who got caught with a good amount of weed and is still in pharmacy school.
 
Seattle, Toppenish, Cincinnati and Cleveland is what I had. I'll be trying NYC/NJ area next year 🙂

Are you officially licensed yet? If you are not, you are not out of the woods yet. The board of pharmacy will need to do a background check and live scan before they issue you a pharmacist license. This is done after you have passed your board exams.

I like to give people chances after chances. This is what makes his country great. Just don't get caught stealing a Vicodin tablet. If you do then we would need to send you to rehab before we give you another chance.
 
The board of pharmacy has known about it since nearly day 1 when I sent them a letter explaining the situation and the result. I was able to receive my 4th year student intern license and I already received my degree so I'm thinking (assuming) I'm, still good to go? Appreciate the info, I'll check it out but I'm sure I'm fine.
 
Someone close to me had a 2nd degree felony charge 15 years ago and was not convicted. He got job offers from both retail and hospital.
 
I never put anything it my pockets until it's paid for... that's just a big no no.

Even if the incident is 100% removed form your record and dropped, some stores still participate in a voluntary theft database that you may end up in permanently.

That being said - I doubt you will not be able to find employment somewhere. I know of a guy who was fired on the spot at a gas station for getting a DUI and was hired by the city making 3x as much a few weeks later. It just depends on the employer.

I would hope an innocent person with no convictions would not experience difficulty landing a job.

Sometime not convicted is not the same as innocent. There is still a record from a background check.

Is there any way to get that removed from your record? It doesn't seem fair that a not-guilty person is treated as if they were guilty of a crime, but that's America for you.

unless they were convicted or gave an alford plea it will not be on your record - arrests that don't lead to a conviction do not appear on a back ground check
