I'm not sure where this goes but since I'm not in school maybe predental is the place.

I'm trying to establish residency in another state and I've lived here for 4 months already, I work here, pay taxes, I'm considered finacially independent from my parents, I have a drivers license from the state, voter registration, and will have lived in the state more than a year from the first day of class in the upcomming year.

However, the form I have to fill out and the defining rules found online list that I have to have my car registered in the state for more than 1 year before the first day of class. My question is I do not own a car so do I have to deal with this clause? I am driving one of my parent's cars and in no way believe I have to register it under my name if they own it. I find it ridiculous that this one aspect of my residency could possibly prevent me from getting into my school of choice (and my birth state mind you) but from what I've read they take it pretty seriously.

Has anyone else here dealt with an issue like this, and am I safe by not having the car in my name? I assume many many students don't own cars and don't register their parents car in the neighboring state. I also don't know what would happen if you bought a new car after moving to a new state and couldn't have it registered for a year before class starts. That seems so stupid; why buy a car if it's going to keep you from getting into school which will eventually pay for the car? Any help on this issue would really help set my mind at ease right now.
 
Interesting that they require the car registration. Most states I know of ask that you have a primary address in that state for 1 year. I know Cali req's you to file your 1040 for two years before you gain residence. If you don't file taxes, you're out of luck there.

Contact the school's administration. They may know something since they bill the students according to residence. If they don't know, they should know who to talk to about it. Unless you live in Cali it sounds like you're a resident, but I could be wrong.
 
a person's domicile is defined as the place where that person resides with the intent to remain there indefinately. When they try to determine whether you intend to remain there, they consider a series of outside factors. One of those factors is where your car is registered, keeping in mind that there are other factors involved. What you'll have to do is to demonstrate that you've let go of all your ties to your previous state...in ways that can affect documentation.

Another thing you can do is to close all bank accounts in other states and start one in your current state.

look at some applications for state schools and determine what factors they consider when determining state residency. Change everything you can to your current state to demonstrate that it's your intent to remain there indefinately, not just for school.
 
The funny thing is after moving here I do in fact plan on staying here. Until this storm hits, I think I'm one of the best places in america. I want to know if I can just tell them I do not own a car; infact I do not own a car. The other strange thing about my situation is I lived 1 1/2 years in another state on my own that was separate from my parent's state. Then I moved back to the home state for 5 months, and then moved to where I am now. While it might look like I move around a lot (really I was having fun post college), I think I can show that I'm not really tied to my parent's home state. This is all just a big hassel, I'll have to keep you guys updated....hopefully for the better.


One other question, my taxes for this year are going to have 3 months in another state but I will have like 14 months of taxes by the time school starts next year. Is there a way to get documentation showing what I've paid already (definitely more money this year goes to my current state)? Otherwise I'd have to wait till Jan to get my W2 which would be late in the process.
 
what if you didn't own a car?
 
I'm thinking I just need to put down that I don't own a car period. I wouldn't be lying and I won't have to deal with explaining my situation. However I do think my parent's car is illegal registered in their homestate but hey that's their problem until I possibly get pulled over. If I get into school they can write me all the tickets they want
