Hello There..I request for help regarding may Visa Status.
I am On H4 visa and I am going to start school from July. I wonder if transferring my Visa to F1 will be advisable for me in long run or not.
The points I am looking at is
1. getting internships
2. When I graduate in June 2010. I ll have missed the chance to file H1 in time.So on OPT I ll be able to work.
Looking at H1 crisis is it wise to be studying on H4 or F1?

My husband is expecting his green card date in 2011. It is already filed.

Please help me here.

If you already have your green card pending then it is not advisable to change over to F1 since this might delay or totally stop your green card processing.You have showed your intention to stay in the US by filing your green card.F1 visa is a student visa with the intention of going back to ones country of nationality.

Its advisable to consult your husband's work place lawyers/HR/immigration lawyers for that.

If he has applied for GC, you will get EAD if your 485 application is pending.
If you are not that far along in the process, don't worry as it will not impact your change of status from H4 to F1.
Why do you want to complicate, just stay on H4 and go to school.? It's up to you.

Please advice.

I am currently on H4,studying in a 2 yrs mba program.
My husband has applied for greencard but wer still in the I-140 stage. I believe at this stage my name does not appear on the list.I am thinking of changing my status to F1.The clear reason is , that I do not think that by the time I graduate, I will get my EAD.theGC was filed in 2007.
So , i want to avail of OPT and internship.
Are there chances of the Visa getting rejected.
Also, incase I go to Canada for the f1 stamp and they reject it there, can i come back on my H4 visa that will stil be valid uptill 2012?

you can apply in Canada if are resident there - usually they want us to apply in the country of residency.
if you can rejection for F1, nothing stops the consular officer to cancel your H4 - just check this ?
it is hard to prove you will leave after you graduate F1, as you have already intention to stay, as you are on H4
