Can I ask why you're considering an SMP? Your GPA is fine, and I think you'd probably be better served doing something else (addressing any holes in your app--research, service, etc.) during your gap year. Regarding the IA, you need to do everything in your power to avoid getting this IA on your record, even if it means hiring a lawyer right now (my wholehearted recommendation). An IA for failure to report will be a HUGE red flag.
