I had a disagreement today with another pharmacist on a legal issue. I have always thought it was illegal to let a patient pay for a prescription copay with a gift card (my retail chain has a coupon offer for transfers). The other pharmacist assured me it was only a COMPANY policy that prevented this... thoughts? Help? I can't seem to find the actual law online....I plan to search more tomorrow....but would appreciate help. thanks
 
It depends on the State.

Why do you think it is illegal? Better yet why do you think the federal or state government would have taken the time to address this issue by making a law? Come on, use your head here. I have never seen a group make up more laws and regulations than pharmacists.

I am sure your company has a policy against it. Such as gift cards for transfers cannot be used to pay the copay on the prescription that was transfered.

I do believe that the federal and state governments take time to make a lot of ridiculous laws.....and as a hospital pharmacist who recently made the switch to retail I'm doing my best to catch up on some laws that I haven't used. It IS a company policy, I was simply asking if it originated with a law. Pardon me!

there's no law (here anyway) that prevents you from giving away your inventory. when the board comes they dont have a right to look at your money books. so here in texas they don't care as long as it is from a valid rx

You are partially correct. You can't use gift card from a transfer coupon to pay for your medication if your insurance is sponsored by the government. But if your insurance is private, then there is no law against it.

Thanks for your answer, this is what I was getting at with my "stupid" question.

It may be a small thing to worry about, and I do realize there are bigger fish to fry. As I stated before, I am trying to learn and trying to make sure that I do everything correctly. I thought this (being a professional forum) would be a good place to draw off of my colleagues experience... apparently not. Adios!

You are incorrect. A Gift card can be used to pay for a welfare prescription. A gift card is legal tender in that store. If my mom is on welfare and I want to pay for her copay's and I buy her a gift card, why does that state have any say.? It doesn't

What you can't do is issue a gift card for a new or transferred rx for a patient on government assistance because you are inducing the government to spend money
 
Old Timer is correct. You can't issue a gift card for a transfer rx if the patient's insurance is sponsored by the government.

On the contrary there is no such thing as a stupid question. Questions are inanimate objects and really can not be called stupid (or smart). So therefore it must be the person asking that is stupid.

You live on Long Island and prefer the NYC water? That's like paying for Keystone when someone hands you a Guinness.

NYC water def tastes better than long island water... my friend is a con ed engineer and I know where our water is coming from...
