do i have to mark yes to this question if i have had my misdemeanor expunged? the way im reading it, it looks like i can say no? HELP!

Have you ever been convicted of, or pleaded guilty or no contest to, a Misdemeanor crime, excluding 1) any offense for which you were adjudicated as a juvenile, 2) any convictions which have been expunged or sealed by a court, or 3) any misdemeanor convictions for which any probation has been completed and the case dismissed by the court (in states where applicable)?

Isn't that your answer right there? I would think that means you can answer "No" since your record was expunged. You can double check with AMCAS, but that's how I read it

But it says to report convictions for which you have been expunged... are you absolutely sure that expunged convictions can in no way possibly be found. Because if they can and they show up, you are in trouble. It's just a misdemeanor, what was it for?

Silas,

I would DEFINITELY report the expungement. I work in the financial field and it is amazing what comes back on criminal background reports. Depending on the criminal background check being conducted results may vary. NOTHING is ever erased from one's federal background check. At my company people are automatically disqualified for failure to disclose. I am always upfront with people that our background checks will show expungements and people still fail to disclose them. Honesty is always the best policy.

yea i kno wat u are sayin, but the way the question is being asked i can say no to it because it was expunged, right? BECAUSE IT SAYS HAVE U EVER BEEN CONVICTED EXCLUDING CONVICTIONS WHICH WERE EXPUNGED?

For what it is worth, I would say leave it off...it does say to report anything....NOT EXPUNGED..

If it absolutely says "do not report those which have been expunged" then you can say no. If it says "report all" and does not mention "expunged", you would have to say yes.

I would read this very very carefully. And be sure to have the documentation to back up the expunged part. Sometimes paperwork gets misplaced, lost, or just flat out not done in a timely fashion.

It says "excluding any convictions which have been expunged..."

Leave it off.
