Anyone have any idea about applying for unemployment due to Covid-19 as a 1099 independent contractor? I work in Virginia and our state board has regulated us to emergencies only and our governor has shut down all non-essential businesses until June 10 so anticipating we won't be able to open before then. I'm going to be pretty far under water here soon if I'm off work for 3 months with no paycheck (started closing the office March 17). My collections is almost completed. Any support or help would be great. Thanks!

Do you set up an S-corp and pay yourself? That’s what my wife and I (we are both dentists) have done. Right after graduation, my wife and I both worked for the corp and got paid 1099. Our CPA recommended us to set up an S corp and pay ourselves. When my wife was on her materity leave, she filed for unemployment and she got the unemployment checks.

I don’t have an S-Corp. I was advised by multiple accountants in my area not to based on tax filing status, etc. Plus, it’s too late now to start one since I’m already unemployed sssooo now what?

I’ve never filed for unemployment before so I don’t really know. I remember during my ortho residency when I didn’t get enough student loan to pay for things like food and rents, I used the credit card convenience checks to deposit into my bank account whenever the fund ran low. And I just made the minimum payments on the credit card debt every month. Can you just do this for now? It’s only temporary. You should be able to pay it back once you are back to work.

If you’re a GD, you’ve been misclassified as an independent contractor when you probably should have been an employee. Contact your state dental association and ask for advice. If you’re a member, they may be able to point you in the right direction. When you come back or when you seek a new job you really should fight to be a W2 employee.

I remember my lawyer advising me not to take on GP associates as 1099, in case they ever file for unemployment, as in CA they are definitely classified as W2s. Boy am I happy I listened for advice, as there are limitations abound right now for those who tried to save a buck on payroll tax...

It seems like there’s provisions in the new CARES act for us but it’s going to take awhile.

Any 1099’s out there filing for the EIDL and PPP loans. Thoughts?

Also, W2 wasn’t an option. It was 1099 or no job. This is pretty common in my neck of the woods. Frustrating, but as a new grad, I didn’t have a lot of options. Took a long time to find any job that wasn’t trying to just use me as a hygenist.
