What is considering IN/OUT of State?

If i finished my undergrad in one state(let say TX) and decided to take more upper level classes for one semester at another outofstate university (NY).

so when i apply am i considered In state for TX or NY???

It depends on which state you're an official resident of. If you went to a public school in NY, did you pay in state or out of state tuition? You can check what the requirements for both states are to claim residency and see if you meet them.
