Actually, the lady is completely uninvolved at this point. Her claim has been filed and her fender was replaced, evidently. The insurance company is basically coming after me with the claim that this accident was 100% my fault and they should get the money they paid out for her claim back. I sent a few letters indicating my opinion that it was a faultless accident and we should each be responsible for covering our own losses, whether they be medical or damages to our vehicles.
Now they have filed a suit against me (after threatening to do so a few months ago, which I took as a low cost way of bullying me into giving them at least some money) and they have a lawyer ready to state their case. I've reviewed the police report that was filed and for some reason the officer stated that my bike looked "old" without asking me how much care I took with the repairs (the brakes were in tip-top shape) and indicated that she thought it could have been due to inattention simply because I hit her from behind and she had never seen an accident like that. Again, this cop took all of 5 minutes to interview us (not separate interviews, I might add) and cited neither of us for unsafe driving/biking or excessive speed.
That being said, I think that I'm screwed. I have no real witnesses of the accident, and the police report certainly doesn't favor my case much (although I might argue that it definitely doesn't make a strong case for it being 100% my fault). They have some kind of dirtbag lawyer willing to try the case for them and if they are able to talk me into some kind of corner/have a judge that hates med students for some reason I would be out the $932 they are asking in addition to their court costs, etc. I imagine those could run an additional few hundred dollars at least. So, my most conservative move might be simply to try to settle for a figure slightly less than the $932, which as I indicated, would force me to live the rest of my life with sneaking suspicion that I am a coward. 😡
