Hi Everyone,

I would like some advice from some of the members. I have been recently dismissed from a pharmacy school due to factors other than academic performance. I would like to start over but I am not sure what the future holds for the career.There is no longer a shortage for pharmacists and I am worried about finding a job. Also, if I do reapply, I would like to apply to a school that is accelerated but I'm wondering if a school's ranking affects opportunities of finding a job?

Following everyone's advice, I contacted dozens of lawyers in the past two days. NONE of them could help me to fight my case and they do not even know where to start... I am from Denver, Colorado. If anyone know any lawyers who specialize in education law or disability law, please PM me. Thank you very much!

I will add and edit some of my later posts here so everyone can get a full story from the beginning.

"Okay.. Let me give everyone a full story. I was accepted into pharmacy school in 2006. Prior to that, I always excelled academically. It was very hard for me to move into a new state and being in a new environment. At that time, my significant other also broke up with me. I was diagnosed with major depression and starting taking anti-depressants. During that time, I failed a course. I returned next year and completed it successfully but was still struggling with school. I spoke to a guidance counselor about my difficulties and was directed to a learning disability specialist. At that time, a 3 hour long assessment was performed on me and I was diagnosed with a learning disability. After making some accommodations with my way of learning and allowing extra time on exams, my academic performance was fine again. In my 3rd year, I failed a 9 unit class which brought my GPA way down. Each year, 10% of the class fails this course so it is a very difficult course. I returned next year and successfully passes the course which lead to rotations. I really did not do anything wrong at the rotation except for calling in sick, being late and lacked motivation. In the end, my preceptor actually did not recommend a grade and it was the school's decision to assign a F. Because of 6 unit F, my GPA again dropped below the minimum requirement (I had 1.94 and the required GPA is 2.0). If I were to take some courses and bring up my GPA, it would mean I need an additional 6 weeks to finish rotations to beyond the school's 6 year policy. I appealed to the school's scholastic committee for 6 week extension and it was denied..."

I don't know if I have a case if I seek legal help...

"I will go seek Legal advice right now. My concern is that the school have it written on the student handbook that there is a 6 year policy. If we have any extenuating circumstances, and we needed to to extended, we can appeal to their committee. In my case, it was denied. I tried to ask for reasons why it was denied but they couldn't not give me additional information. I then went to the assistant dean who was in charge of this process and he said the committee's concern was due to me being inconsistent in my academic performance. But, I been doing really well in the past year and if they would let me continue, I will be fine... I don't know if my learning disability and mental illness would be considered an extenuating circumstance."

"I spent the whole day emailing lawyers (~20 or so) and seeking help. Most of them don't even handle my case! At this point, I am willing to spend some money on an initial consultation and see if I have a case. I am just losing confidence because the school are not violating their school policy and I am fighting against a PUBLIC STATE school."

Some members has suggested that I should fight the rotation grade and fight with the preceptor. However, that grade is already assigned and I am not sure what else can the preceptor can do at this point. (BTW, he was on vacation for half of my rotation.) The preceptor suggested "I do not recommend a grade" and it was the school's decision to assign a fail grade. It is written in the syllabus that the school has the option to assign grades if no grade is assigned. I spoke with the preceptor and he said he did not fail me and it is the school's decision to fail me. He is not willing to help me out at all.

From the school's end:

The associate dean is willing to help me out. He tried to tell then committee to give me a chance but the committee is firm on having me dismissed. I have worked with the associate dean before and he is impressed with my patient care skills and my compassionate heart. He tried everything to help me and even spoke to the dean on my behalf. However, the dean cannot do anything because is not in the school's policy.

My question is, would it help if I go to the dean of the school? What if I go to the school's chancellor or the president or something? It is not in the school's policy to go beyond the committee so I don't know if they would even care to hear me out. I spoke to the ombuds office and the ombuds office said they probably would refer me back to that committee.

Because I could get any lawyer's attention, I posted my situation on a education law forum and this is what one of the senior members replied:

" It would appear that it wasn't your initial grades doing the damage - you said that you failed your rotation, and this was after accommodations had been made.

The school wasn't obliged to offer you extra time (and perhaps in fact couldn't offer you extra time) if their standard is 6 years. You had a contract to complete in 6 years - if you did poorly even after accommodations were made, that isn't the school's problem.

I'm sorry, but some students just don't make it through school."

After giving him the full story, he said:

"I still don't see any legal recourse for you.

Sorry.

(Bear in mind that 90% of students did not fail the course you mentioned - that is actually quite impressive)"

So at other pharmacy schools, is it normal that 10% of the class fails each year from one course?

My school's policy is that I can reapply after 4 years[FONT=&#23435] but Ido not want to wait that long. I think accelerated program would be agood option because it is not the didactic knowledge that I lack butprofessionalism and work habits. I was actually doing rotations before theydecided to fail me out. [FONT=&#23435]I had a bad relationship with ONE preceptor and he gave somepretty negative reviews to my school. I have had postive reviews from all previous preceptors except this one. Unfortunately, it went so bad that it caused me to fail a rotation. ..[FONT=&#23435]Of course, I had other academic difficultiesin the past but I was able to pull through them. Each of our rotations are 6units and are graded as pass/fail. Failing this 6 units rotation dropped my GPAbelow the minimum requirement. I appealed to the school asking for couple ofweeks extension so that I can pull my GPA up this semester and finish rotationsnext year but it was denied. I LOVE this field and LOVE what I do but [FONT=&#23435]withthe amount of student loans I have built up, I do have .to be realistic[FONT=&#23435]. I maynot be the best student but it does not affect my passion to provide good patientcare! ..

I was wondering if there are any schools that would allow me to transfer my credits over or perhaps start with rotations?

No. Appeal the school's decision. That is just the only recourse I see for you. Any school that will let you transfer in is going to start you from scratch. I have never heard of getting to skip any portion of pharmacy school, not even for transfers and certainly not someone who is not even a transfer strictly speaking. You wouldn't be transferring, you would be applying.

I appealed and the appeal was denied. Our school strictly follows their policy and is unwilling to bend it. I only needed an additional SIX weeks to finish the program...

Being that you were in your last year, you have some things to think about. Your appeal has already been denied. Do you want to start from scratch and double your student loans? Pharmacy school isn't cheap...how will you pay for the loans you have? I would do anything and everything (maybe even legal consultation) to try and help overturn their decision. Looks like you have already been given multiple chances over the last four years.

Yea, I was given other chances and each time, I was able to mov[FONT=宋体]eforward. I have had a lot of medical issues in the past which resulted in some Cs.However, I passed all the graded courses at my school and it is the pass/failcourses that lowered my GPA. This time, it was due to a bad rotation. Again, Iwas sick, the preceptor did not like that, there were some miss communication..and so on... This was totally unexpected and I really do want to continue. Ifinished the didactic portion and just needed to complete rotations[FONT=宋体] tograduate.. Unfortunately, at this point, they decided to terminate me. Iam also thinking about legal consultation but I am not sure if there are anyavailable for low income clients..

Get an attorney. Why dismiss a student who has only 6 wks left to graduate from pharmacy school. some preceptors are heartless.

You might have a pretty good legal case if it's a medical concern.


I have so much financial debt right now and I cannot afford any lawyers. I am looking for some lawyers that offer legal advice for low income clients but cannot seem to find any.

Did you ask to repeat the rotation you failed ?

is your school USP in philly by chance?
 
What exactly did you do to this preceptor that caused them to give you such a bad rating? If it was a medical issue then lawyer up if you know what I mean.

I was sick two times due to being ill so I called in sick. I was also late a couple of times during the beginning of the rotation. He went to vacation during the midpoint of my rotation and came back later to evaluate me and give me the bad review. He said I lack professionalism, motivation... He also accused me of surfing the internet and using a cell phone all the time. I brought in my cell phone bill to show the school that I did not but I doubt it made a difference. I just can't believe I made it this far to rotations and I am months away from graduation and then they decide to dismiss me...
 
I'll reiterate what others have said : get a lawyer. look up legal aid in your area, you probably qualify for it.

There are so many steps (and many loopholes in those steps) a school has to go through to actually dismiss you ...you need someone who speaks the legal-ese and knows how to file the proper paperwork for a formal appeal. You have an even greater chance if you go to a state school..their loopholes are hugeeeee.

I did! I even said I'll do extra rotations to show how biased that preceptor was. But the school said NO.

I would keep bordering the school until they agree to let me repeat the rotation. Tell them this is all you have and there is no reason to dismiss you. At the same time you need to see a lawyer. I don't think you should try to apply to another pharmacy school because i don't you can do that.

I also want to take legal action but I do not know who would hear my story without having to pay them the big bucks? Are there any lawyer that will represent low income clients?

What if I fight and lose? I will be in more financial deficit. I am actually looking into lawyers who will provide help to clients with disabilities. I am not sure if learning disability or mental disability would be considered one of them.

this sounds like the bull**** they try to pull at wvu for kids that have social or mental health issues directly related to the obnoxious amount of stress associated with pharmacy school. They don't understand you, nor particularly care to. Is what it is. Just remember that in the long run, all of them are rather insignificant people outside of their little world of academia. You'll lawyer up, they'll slink away, you'll do your last rotation, and in 5 years none of this matters. I've been there. And, indeed, none of it mattered.

I would think so. I can't imagine that they could include a legitimate medical issue in a 6-year period in which you are expected to complete something.
 
I've been there too and lawyer will scare them sometimes. go see a good lawyer. Your lawyer should focus on your rotation grade. your preceptor didn't give you any grade because he/she couldn't justify failing you. Don't fight the school handbook, concentrate on the rotation grade. You have to dispute the rotation grade.

But what type of lawyer should I be seeking for? How would I know if it is a good lawyer?
 
wtf kind of school does this? Dont they want a high graduation rate??? I know plenty of people that have failed a rotation, but crap man, they were able to sign up for new ones.... post the name of your school so people know to stay far away!
 
Look for an educational attorney. Call the lawyer referral service in your area for recommendations.

OP, you have to do some footwork with the info that you've been given. You need to be incredibly proactive in order for you to finish your degree. We're talking about your livelihood, so frankly ... If you want your degree, you should continue calling lawyers until you can find one to take your case.

If you want your degree, you should continue calling lawyers until you can find one to take your case.

I been very proactive regarding this matter. I called dozens of lawyers since yesterday and none of them could handle my case. I am going against a public institution and it is just very difficult. Also, I don't know if it would be a civil case or a disability discrimination case.

Have you looked up the law help services in your area for low income? If not, if you post what city/state you're in now, someone might be able to come up with that info. The one in Phoenix will make an appointment to sit down with you & at least talk about your case, then make a determination from there.

They also offer debt relief services through their non-profit activities. (Although that's neither here nor there in this case - it just happened to be why I was looking them up for someone.)

God no! don't use any attorney that has anything to do with the school. They will get to your attorney and you are done. Don't discuss your case over the phone when you call an attorney's office. Schedule an appointment to go in and speak to the attorney. Have everything documented and be prepared because they will bill you by the hour. My school has mid-rotation evaluation when a preceptor is supposed to discuss whatever issues they have with you, document ur progress and sign. if your preceptor didn't mention any of the reasons he/she gave for bad recommendation during mid-evaluation then you can claim to not know that you were doing poorly on the rotation. Does he/she have any record that he /she tried everything to help or assist you during your rotation. When you called in sick, did he/she approve that you take the time off ? do you have doctor's report that can support your illness claim. your preceptor's claim about you using phone while on site is his/her words against yours and he/she will have to prove it. I will go after the preceptor not the school.
 
Apologies for the bad advice pointed out above. I was wracking my brain trying to think where I'd go for a lawyer, but on second thought, that is probably a silly suggestion.

No I sincerely thank you for your advice. I have tried all of those sites you listed and had minimal luck. I was able to get a hold of two education lawyers but they charge an initial consultation fee thats in the hundreds. I just don't know if I even have a case and if it is even worth fighting for. I am fighting against a public institution after all.

You have a valid point and I did not think about this until now. However, the grade he gave me was "I do not recommend a grade" and it is the school's experiential committee that assigned a failing grade. Even if I sue the preceptor now, he cannot go back and change the school's mind.

Man I have contacted numerous people in the past couple of days and none of them was able to change the committee's decision. I feel so helpless.

No I sincerely thank you for your advice. I have tried all of those sites you listed and had minimal luck. I was able to get a hold of two education lawyers but they charge an initial consultation fee thats in the hundreds. I just don't know if I even have a case and if it is even worth fighting for. I am fighting against a public institution after all.

Is there something you are not telling us? Hundreds of dollars weighed against years of your life and however many thousands of dollars in debt!?

Look here is advice of basically everyone in this thread: Get a lawyer, NOW! No one here can tell you if you have a case. Does it being a public institute even matter? Just get a lawyer. Now. Stop posting and get a lawyer. Go.

Why are you even reading this anymore? You should be getting a lawyer.

Oh I have nothing else to hide and I am definitely in the process of hiring a lawyer. I spent the whole day emailing lawyers (~20 or so) and seeking help. Most of them don't even handle my case! At this point, I am willing to spend some money on an initial consultation and see if I have a case. I am just losing confidence because they are not violating their school policy and I am fighting against a STATE school. I was just looking for more advice and maybe someone would something anything specific to offer. I guess I am here for emotional support as well. I am sorry.. its just that this is a VERY DIFFICULT situation for me.

After hearing what my school told me, I don't think there is anything else I couldn't handle to hear so all opinion is appreciated! (postive or negative)
