The CPJE 90-day retake requirement is not the law?

I've looked over the law book pretty carefully and I can't find ANYTHING about a 90 day waiting period for retaking the CPJE. At this point I'm thinking it is an arbitrary rule created by someone at the BOP that isn't based on the actual law.

I do see section 4200.4. says:
"An applicant who fails the national examination may not retake the examination for at least 90 days or for a period established by regulations adopted by the board in consultation with the Office of Professional Examination Services of the department"

So you'd have to wait 90 days for a NAPLEX retake... but there seems to be nothing mentioned about the CPJE.

Where does the 90-day CPJE rule come from???

The 90 day waiting period is stated on the pharmacist application.

"If you do not pass either examination, you will need to submit a Retake Application (17A-1A) to the board. You will not be allowed to sit for either examination until it has been 90 days from the date of your last examination."
